On the Translation of Litigation Documents with Foreign Elem

　　随着全球化进程和中国改革开放进程不断深入,中外法律文化的交流也呈现出蓬勃发展的态势。法律翻译的重要性和紧迫性不言而喻。诉讼文书,作为一国法律的重要载体,明确了当事人的权利义务关系,体现了公正司法、维护社会公平正义的宗旨。当前,学界对涉外诉讼文书翻译的研究尚未形成专门系统的理论体系,而实践中涉外诉讼文书的翻译更是参差不齐,谬误百出。有专家指出,法律文本翻译的研究水平远落后于文学翻译和科技翻译等领域的研究水平。但是值得一提的是,韩礼德提出的系统功能语篇分析为翻译研究和翻译实践提供了强大的理论支持,也为法律翻译的研究领域开拓了新的局面。笔者拟从语篇分析的视角出发,对涉外诉讼文书的翻译进行全面系统的研究。首先,对涉外诉讼文书的基本概念加以阐述,介绍涉外诉讼文书翻译的基本情况,对涉外诉讼文书翻译中常见的问题和原因进行分析归纳,指出本文研究的现实意义。其二,从语篇的内部因素出发,对涉外诉讼文书翻译过程中的遣词构句、语体特点,篇章结构进行深入探讨,以期在语言的表层结构上提高涉外诉讼文书的翻译质量。其三,从语篇的外部因素出发,对产生涉外诉讼文书特有的司法语境、法律体系和社会功能进行研究,并指出在中国特有...
