互联网新闻聚合传播对版权的影响及其对策

【摘要】：本研究将结合国内外典型案例,着重探讨新闻聚合传播对版权的冲击,分析新闻聚合引发的版权纠纷及其面临的法律困境,并探寻造成这些问题的原因,同时做了网民对于新闻版权意识的调查,最后提出新闻聚合侵权的解决之道。通过借鉴国外新闻聚合传播版权保护的相关经验,可以制定出适合中国国情的版权保护措施。旧的版权法律已经不能适应新闻聚合传播领域的新业态,这一困境也不仅仅是探讨侵权问题那么简单。从长远来看,需要平衡新闻内容创作者、新闻内容提供媒体与新闻聚合平台的经济利益关系,建立一套合理共赢的利益分配体系。版权法应致力于为新旧媒体的创新提供公平自由的环境,平衡各方的利益分配以建立合作机制,从而促进新闻信息的流通和资源利用最大化,同时为新闻作品版权提供适度保护,防止其价值被新技术所侵蚀,激发内容生产者的原创活力,增强新闻生产的质量,提高新闻聚合传播的效率,创造新闻传播领域的多赢局面。绪论部分阐述了本文的背景、选题的意义,并对国内外的研究现状进行归纳分析,介绍本研究所使用的研究方法和创新点。第一章介绍新闻聚合传播对新闻业的影响。从新闻聚合的产生与发展历程入手,分析新闻聚合传播的模式与特征,进而总结出新闻聚合传播对传媒业的变革,引出新闻聚合平台的存在的问题。第二章以“今日头条”为例,探究互联网新闻聚合传播产生的版权问题。本章通过深入剖析新闻聚合产生版权纠纷的典型案例——“今日头条”,总结“今日头条”的传播特点,深入分析其传播特性,进而阐释新闻聚合传播引发的版权争议,找出问题所在。第三章剖析新闻聚合传播产生版权纠纷的原因。本章结合网民对于新闻聚合版权意识的问卷调查,并得出一系列结论。引起新闻聚合传播的版权问题有其多种因素,版权认识差异,法律滞后造成版权管理工作混乱,尚未探索建立起有效的维权模式。第四章探讨解决新闻聚合引发的版权问题的对策,结合目前国外新闻版权的保护现状以及其治理措施,进行国内外新闻版权立法的规范比较分析,并以此为借鉴和参考,最终提供对新闻聚合传播产生的版权问题的建议,阐述具体的解决策略。建立互联网新闻版权法律法规体系,加强各传播主体的行业自律,构建完善的版权集体管理与维护制度,加强互联网道德观念和新闻版权意识;探索公平合理的利益分配模式,建设版权产业运营及利益分配体系,创立开放高效的“新闻共享与版权维护”平台。结语部分做出总结,并展望新闻聚合传播的未来。
[Abstract]:This study will focus on the impact of news aggregation on copyright, analyze the copyright disputes caused by news aggregation and the legal difficulties it faces, and explore the causes of these problems. At the same time, the author makes a survey of news copyright consciousness, and finally puts forward the solution of news aggregation infringement. By drawing lessons from the relevant experience of foreign news aggregation and dissemination copyright protection measures suitable for China's national conditions can be worked out. The old copyright law can no longer adapt to the new form in the field of news aggregation and communication. In the long run, it is necessary to balance the economic interests of news content creators, news content providing media and news aggregation platform, and establish a set of reasonable win-win benefit distribution system. Copyright law should aim at providing a fair and free environment for the innovation of new and old media, balancing the distribution of interests between all parties in order to establish a cooperative mechanism, thus promoting the circulation of news information and maximizing the utilization of resources. At the same time, it provides appropriate protection for copyright of news works, prevents its value from being eroded by new technologies, stimulates the original vitality of content producers, enhances the quality of news production, and improves the efficiency of news aggregation and dissemination. To create a win-win situation in the field of news communication. The introduction part describes the background of this paper, the significance of the topic, and domestic and foreign research on the current situation of induction and analysis of the research methods and innovative points used in this study. The first chapter introduces the influence of news aggregation and communication on the news industry. Starting with the emergence and development of news aggregation, this paper analyzes the mode and characteristics of news aggregation communication, and sums up the reform of news aggregation communication to the media industry, which leads to the problems of news aggregation platform. The second chapter takes headline Today as an example to explore the copyright issues arising from Internet news aggregation. This chapter analyzes the typical case of copyright disputes caused by news aggregation, "headline Today", summarizes the communication characteristics of "headline Today", analyzes its communication characteristics, and then explains the copyright dispute caused by news aggregation. Find out what the problem is. The third chapter analyzes the causes of copyright disputes in news aggregation. This chapter combines Internet users' questionnaire survey of news aggregation copyright consciousness, and draws a series of conclusions. There are many factors that cause the copyright problem of news aggregation and dissemination. The difference of copyright cognition, the lag of law cause the confusion of copyright management, and the establishment of effective rights protection mode has not been explored yet. The fourth chapter discusses the countermeasures to solve the copyright problems caused by news aggregation, combines the current situation of foreign news copyright protection and its governance measures, carries on the domestic and foreign news copyright legislation norm comparison analysis, and takes this as the reference and the reference. Finally, it provides suggestions on copyright issues arising from news aggregation and dissemination, and expounds specific solutions. To establish the law and regulation system of Internet news copyright, to strengthen the self-discipline of each main body of communication, to construct a perfect system of collective management and maintenance of copyright, and to strengthen the sense of Internet morality and news copyright; This paper explores a fair and reasonable benefit distribution model, builds a copyright industry operation and benefit distribution system, and establishes an open and efficient "news sharing and copyright maintenance" platform. The conclusion part makes a summary and looks forward to the future of news aggregation.
