【摘要】:随着信息文明的发展,从劳动角度讨论人权问题的意义日渐凸显。从人本身寻找人权的根据,"相互性"(reciprocity)概念在逻辑上具有重要地位。作为一种类权利,人权源自人的类特性,而最基本的人类特性就是相互性。相互性具有物能和信息两个基本层次,劳动创造性的提升使人类相互性越来越是信息层次的。创造性劳动成果的共享性质具有深刻的人权普遍性意蕴,创造性劳动的发展越来越意味着人权的发展。为创造性的自由劳动营造良好的社会生态环境是人权保障的重要方面,而信息生态建设将会是越来越重要的人权保障内容。人权作为一种类权利,从社会表现形式来说,是以人类创造性劳动的相互性为重要根据的法律规定;而就人类需要而言,其实质则是以创造性劳动的相互性为重要根据的深层预设。这种预设是保障以相互性为基本特性的人类自身的尊严,是保证人类社会公平正义所必不可少的。
[Abstract]:With the development of information civilization, the significance of discussing human rights from the angle of labor is becoming more and more prominent. The concept of "reciprocity" plays an important role in logic. As a kind of right, human rights derive from the human nature. The most basic human characteristic is reciprocity, which has two basic levels: physical energy and information. The promotion of labor creativity makes human interaction more and more information level. The shared nature of creative labor results has profound human rights universal implication. The development of creative labor increasingly means the development of human rights. It is an important aspect of human rights protection to create a good social ecological environment for creative free labor. As a kind of rights, human rights, as a kind of rights, is an important legal regulation based on the mutual nature of human creative labor. As far as human needs are concerned, the essence of this presupposition is the deep presupposition, which is based on the interaction of creative labor, which guarantees the dignity of the human being with the basic characteristic of reciprocity. It is essential to guarantee the fairness and justice of human society.
