社会共同体秩序的建构:马克思的利益观提供的启示

【摘要】：国家是人类历史上最为重要的群体化生活方式之一,维持这一群体的社会秩序是现代国家的基本职责。社会秩序如何可能一直是法哲学的研究热点之一,霍布斯、洛克、卢梭、涂尔干、帕森斯等人都有过经典的论述。当前,在我国实现国家治理现代化的进程中,如何整合社会、构筑以法为基础的社会秩序同样是一个非常现实的考验。本文拟通过对马克思利益观的梳理和再认识,提出以马克思利益观为指引,以尊重和保障利益为核心的社会秩序建构路径,即以尊重和保障利益为基础;以社会组织代言个体利益为社会结构条件;以平等的利益博弈平台为机制要素;以权威的利益纠纷解决机制为社会良序的平衡器。
[Abstract]:The state is one of the most important mass lifestyle in human history, and it is the basic duty of modern country to maintain the social order of this group. How the social order may have been one of the hotspots of the philosophy of law, Hobbes, Locke, Rousseau, Durkheim, Parsons and other people have had classical exposition. At present, in the process of realizing the modernization of national governance, how to integrate the society and build a social order based on law is also a very practical test. By combing and rethinking Marx's concept of interest, this paper puts forward a path of constructing social order, which is based on respecting and safeguarding interests, guided by Marx's view of interest. Taking social organization as the social structure condition, taking the equal benefit game platform as the mechanism element, and taking the authoritative interest dispute resolution mechanism as the social good order balancer.
