《老子》“无为而治”法政哲学的三重意蕴

【摘要】："无为而治"既是《老子》极其重要的政治哲学思想,也是其重要的法律哲学思想,《老子》"无为而治"法政哲学具有三重意蕴。批判的意蕴:《老子》批判其他各家过于强调法律的作用,制定太多太严甚至残酷的法律治理社会,只会使社会处于更加混乱落后的局面。价值的意蕴:《老子》通过否定的方式揭露"有为恶治",凸显"无为善治",《老子》的"无为而治"具有民本思想的光辉。方法的意蕴:"无为而治"是针对"有为而治"方法上的缺陷而提出的,《老子》认识到"有与无"的辩证关系,"有"通过"无"实现。
[Abstract]:"governing without doing" is not only an extremely important political philosophy of Laozi, but also an important philosophical thought of law. The implication of criticism: criticizing other schools too much emphasis on the role of the law, too much too strict or even cruel laws to govern the society, will only make the society in a more chaotic and backward situation. The meaning of value: Laozi exposes "evil governance" through negation, highlights "good governance by doing nothing" and "governing without doing act" has the brilliance of people-oriented thought. The implication of the method is that "do nothing and rule without action" is aimed at the defects of the method. Laozi recognizes the dialectical relationship between "having" and "nothing", and "you" is realized by "nothing".
