礼与法:两种规约形式的符号学考察

【摘要】:礼乐符号与法律符号都是在复杂的社会生活现象之中抽象出来的对人的表意行为进行规约的形式规则。礼的分节控制社会的分层,礼的稳定性带来的是社会秩序的稳定性。法源于礼,法家用术重势,其根本原因在于重建统治阶层的符号宰制权。法家的事功倾向适应了统一的需求,但缺少制动价值则转向极端功利主义,礼法互用是对儒家道德自律下形成的制动价值的肯定。儒表法里的实质是"动制同源",单一的元语言"礼"使得历史演进缺乏必要的符号动力,阻碍了社会的发展。
[Abstract]:The symbol of ritual and music and the symbol of law are both the formal rules which are abstracted from the complicated phenomena of social life. The division of rites controls the stratification of society, and the stability of ritual brings stability of social order. Law originates from propriety, and the fundamental reason lies in the reestablishment of the power of the ruling class. However, the lack of braking value turned to extreme utilitarianism, and the mutual use of etiquette and law was an affirmation of the braking value formed by Confucian moral self-discipline. The essence of Confucian representation and Dharma is "the same origin of movement-system", and the single meta-language "propriety" makes the historical evolution lack of necessary symbolic power and hinders the development of society.
