柳宗元《驳复仇议》的多面向探索

【摘要】："复仇"本身是一个内涵丰富的话题。《驳复仇议》一文借实际案例传达出柳宗元对"复仇"的深刻思考,且与陈子昂《复仇议》、韩愈《复仇状》遥相呼应。柳宗元深厚的公羊学修养,立论的高度与持论的魄力,以及唐代尚侠的社会氛围都是此议能够流传千古的原因所在。同时《驳复仇议》一文也从一个侧面反映了唐代社会关于礼、法问题的热烈讨论,从中可以窥见士人法律意识的普遍觉醒,以及对于如何恰当地调解礼、法冲突,构建司法原则的大胆尝试,其背后的文化意蕴十分丰富。
[Abstract]:"Revenge" itself is a topic with rich connotations. The article "refuting Revenge" conveys Liu Zongyuan's profound thinking on "revenge" through practical cases, which echoes Chen Ziang's "Revenge discussion" and Han Yu's "Revenge form". Liu Zongyuan's profound knowledge of the ram, the height of his theory and the spirit of his theory, as well as the social atmosphere of Shang Xia in the Tang Dynasty, are the reasons for this discussion to spread for ever. At the same time, the essay "refuting Revenge" also reflects the heated discussion on the issue of propriety and law in the Tang Dynasty, from which we can see the general awakening of the scholars' legal consciousness, and the conflict between the law and the law as to how to properly mediate the ritual. The bold attempt to construct the judicial principle is very rich in the cultural implication behind it.
