【摘要】:胡锦涛在省部级领导干部提高构建社会主义和谐社会专题研讨班的讲话中提出我们要实现社会和谐,建设美好家园。和谐社会应该是民主法治、公平正义、诚信友爱、充满活力、安定有序、人与自然和谐相处的社会。依法治国是构建社会主义和谐社会的主要保证,公平正义是构建和谐社会的本质要求。要依法治国,实现公平正义,最重要的是要提高法律人员的素养,尤其是要提高法院、检察院工作人员的素质以及大量执法人员的法律素养。而法律职业者法律素养的提高又取决于对他们进行的法律教育。因此法律的教育和社会主义和谐社会的建设具有密切的关系。法律的教育可以分为以传授学科知识为主的理论教育和以传授操作技能为主的职业教育。我们国家的法律教育现在大多侧重于理论知识的传授,对法律专业的学生技能训练不够。法律职业教育对于提高法律职业者的技能,在我国形成法律职业共同体,推动国家的法治进程具有重大的作用。对社会主义和谐社会的建设所起到的作用也是不可估量的。 法律的职业教育在法学教育中占主要地位,他对于法律专业的学生以及我国司法工作人员的法律素养的提高具有重要作用。随着我国的司法改革的不断深入和法制建设进程不断推进,我国的法律职业教育取得了不小的成就。随着我国对职业教育的提倡,我们有必要在这基础上更好的发展法律的职业教育,使职业教育为国家的发展起到更大的作用。 本文首先从法律职业教育的概念、范围来对职业教育进行了界定,然后分析了一些发达国家的法律职业教育,重点介绍了美国的诊所法律教育模式。诊所法律教育模式是一种进行法律职业教育非常好的模式,被我们国家在2000年引进。本文分析了诊所法律教育模式被引进后在我们国家的一些缺点。 本文分析了我国法律职业教育的现状,指出我国法律职业教育的不足,并详细的分析了造成这种现状的原因等。最后提出建议,建议我们国家应该以诊所式法律教育模式为依托构建新时代的法律职业教育体系,提出要增加法律的职业伦理教育,要完善法律教育的宏观调控,并且要建立一支理论水平和职业技能兼备的教师队伍。文章指出我国目前师资队伍存在的问题,这些问题主要有:教师教育观念落后,缺乏教学动力;教师业务能力欠缺,难以适应法律职业教育;教师整体结构不合理,法律院校的理型论教师充足,技能型的教师严重缺乏,两者数量没有达到合理的比例。并对如何建设师资队伍提出建设性意见,指出教师应该实施走出去策略,提高本校教师的技能水平,应该采用多种方式,实施引进来策略,学校要调整教师考评机制,完善教师晋升政策,以及国家、社会各方面要给予支持等。最后论述了建立这样的法律职业教育体系的意义。
[Abstract]:In his speech at the seminar for leading cadres at the provincial and ministerial levels to improve the construction of a harmonious socialist society, Hu Jintao pointed out that we should achieve social harmony and build a better home. A harmonious society should be democratic and legal, fair and just. Honesty and fraternity, vigor, stability and order, harmonious coexistence of man and nature. Rule of law is the main guarantee of building a harmonious socialist society. Fairness and justice is the essential requirement of building a harmonious society. In order to govern the country according to law and realize fair justice, the most important thing is to improve the quality of legal personnel, especially the courts. The quality of the procuratorate staff and the legal literacy of a large number of law enforcement personnel. The improvement of the legal literacy of legal professionals depends on their legal education. Therefore, the education of law and the construction of a harmonious socialist society. Legal education can be divided into theoretical education based on imparting subject knowledge and vocational education based on imparting operational skills. Legal education in our country is now mostly focused on the transmission of theoretical knowledge. Yes. It is not enough for the students of law major to train their skills. Legal vocational education can improve the skills of legal professionals and form a legal professional community in our country. The process of promoting the rule of law plays an important role in the construction of a harmonious socialist society. The vocational education of law occupies the main position in the education of law. He plays an important role in the improvement of the legal literacy of the students of law major and the judicial staff in our country. With the deepening of judicial reform and the process of legal construction in our country. The legal vocational education in our country has made great achievements. With the promotion of vocational education in our country, it is necessary for us to develop the legal vocational education better on this basis. So that vocational education for the development of the country play a greater role. This paper defines the legal vocational education from the concept and scope of the legal vocational education, and then analyzes the legal vocational education in some developed countries. This paper mainly introduces the clinical legal education model in the United States. The clinic legal education model is a very good model for the legal vocational education. It was introduced by our country in 2000. This paper analyzes some shortcomings of clinical legal education model in our country after it was introduced. This paper analyzes the current situation of legal vocational education in China, points out the shortcomings of legal vocational education in China, and analyzes the causes of this situation in detail. Finally, some suggestions are put forward. It is suggested that our country should build up the legal vocational education system of the new era based on the clinic mode of legal education, and put forward that we should increase the professional ethics education of law and perfect the macro regulation and control of legal education. The article points out the existing problems of teachers in our country. These problems include: the backward concept of teacher education and the lack of teaching motivation; The lack of professional ability of teachers makes it difficult to adapt to the legal vocational education; The overall structure of teachers is unreasonable, the theory of theory of the law college teachers are sufficient, the skills of teachers are seriously lacking, the number of the two has not reached a reasonable ratio, and put forward constructive suggestions on how to build a contingent of teachers. It is pointed out that teachers should carry out the strategy of going out and improve their teachers' skill level. They should adopt a variety of ways to implement the strategy of bringing in teachers, and schools should adjust the mechanism of teachers' examination and evaluation, improve the promotion policy of teachers, and the country. Finally, the significance of establishing such a legal vocational education system is discussed.
