【摘要】:孝道是中华民族的传统美德,几千年来,人们一直把孝视为做人的根本,中国古代的统治者一直推崇孝,并且将孝纳入法律的名文规定中。 本文主要是通过对唐代以前孝道伦理的立法发展演变情况回顾的基础上,围绕孝道伦理,考察唐代孝道伦理的提倡、法律规范,对上至皇亲国戚、百官,下至黎民百姓的孝道伦理进行整理总结,希望进一步揭示对唐朝孝道伦理观念的理解。 本文主要分为五个部分对《唐律》中的孝道伦理进行整理分析。 第一部分主要是讲儒家思想中的孝道伦理思想。我们要讲唐朝的孝道伦理,就应该知道孝道伦理思想的由来,为孝道伦理思想的立法规定寻找思想基础。 第二部分主要是讲唐代以前法律与孝道伦理。孝道伦理的立法不是唐朝专有的,而是经过先秦时期、汉朝时期、魏晋南北朝以及隋朝时期统治者的提倡与立法规定而逐步演变的,唐朝的孝道伦理是对唐以前孝道伦理立法的继承与发展。 第三部分主要是讲孝道伦理与唐代社会,这部分主要是通过唐朝统治者对孝的提倡与践行、孝行对官员的约束、以及庶民的孝道践行来论述唐朝社会孝道伦理在生活中是怎样实现的。 第四部分主要是孝道伦理在《唐律》中的体现。这部分主要是通过从唐律的立法理论基础,到唐律中关于孝的立法规定,对于不孝的惩治方面进行阐述的。 第五部分主要是对唐代孝道伦理的评价。孝道伦理作为中华民族的传统美德并为中国历代统治者所提倡,自然有其积极作用,但是我们也应该看到,在封建专制统治下,孝道伦理也被披上了浓厚的封建统治思想,束缚了人们的思想。 孝是借助于法律的力量得以有效保障,因违反孝道会触犯法律而受到处罚。但是,维护封建统治而使孝的道德与法律相冲突,这在封建专制统治下并不鲜见,这是封建社会不可磨灭的弊端,一切从封建统治阶级的根本利益出发。我们当前构建和谐社会,应该坚持依法治国观念和以德治国观念相结合,真正实现法律与道德的一致统一,实现构建和谐社会的目标。
[Abstract]:Filial piety is the traditional virtue of the Chinese nation. For thousands of years, people have always regarded filial piety as the basis of life. On the basis of reviewing the legislative development and evolution of filial piety ethics before Tang Dynasty, this paper examines the promotion and legal norms of filial piety ethics in Tang Dynasty. From now on to the people's filial piety ethics, we hope to further reveal the understanding of Tang Dynasty filial piety ethics. This paper is divided into five parts to analyze the ethics of filial piety in Tang Law. In the first part, we should know the origin of filial piety ethics and seek the ideological basis for the legislative provisions of filial piety ethics. The second part is mainly about the law and filial piety ethics before Tang Dynasty. The legislation of filial piety ethics is not exclusive in Tang Dynasty, but after the pre-Qin period, Han Dynasty period. In the Wei, Jin, Southern and Northern dynasties and the Sui Dynasty, the rulers advocated and legislated gradually, and the filial piety ethics of the Tang Dynasty was the inheritance and development of the filial piety ethics legislation before the Tang Dynasty. The third part is mainly about the ethics of filial piety and Tang Dynasty society, this part is mainly through the Tang Dynasty rulers to promote and practice filial piety, filial piety on officials constraints. And the common people's filial piety practice to discuss the Tang Dynasty social filial piety ethics in life how to achieve. The 4th part is mainly about the embodiment of filial piety ethics in the Tang Law, which is mainly explained from the legislative theoretical basis of Tang Law to the legislative provisions on filial piety in Tang Law, and on the punishment of unfilial piety. The 5th part is mainly to the Tang Dynasty filial piety ethics. Filial piety ethics as the traditional virtue of the Chinese nation and advocated by the rulers of China, naturally has its positive role, but we should also see. Under the feudal autocratic rule, filial piety ethics is also put on a strong feudal rule thought, bound people's thought. Filial piety can be effectively protected by the help of the law, and it will be punished for violating the law. However, it is not uncommon to maintain the feudal rule and make the morality of filial piety conflict with the law, which is not uncommon under the feudal autocratic rule. This is an indelible malpractice in feudal society, all from the fundamental interests of the feudal ruling class. In order to build a harmonious society, we should adhere to the concept of governing the country according to law and the idea of running the country by virtue. To realize the unity of law and morality and to realize the goal of building a harmonious society.
