理性对待中国的无法、有法、反法与超法——“法律东方主义”的启示

【摘要】:关于中国法律的"东方主义"认知是一种对中国治理模式非常系统化的误读,一种根深蒂固的情绪化偏见。它提醒我们警惕这样一种长期以来存在、也将继续长期存在的现象:因为观察和研究的感情化,使得人们对于中国治理模式(包括中国法律体系)的了解和理解常常处在一种盲人摸象的褊狭状态,即简单化地用"无法""反法"或者"超法"来概括中国的法律制度实践,而无视"有法"才是中国社会治理的基本形态。法律的"东方主义"不仅仅在知识上让我们误读了中国,也在政策上误导了中外的政治家。本文呼吁理性对待中国法律制度实践中无法、有法、反法与超法四种现象共存的状态。
[Abstract]:The "Orientalism" cognition about Chinese law is a kind of systematic misreading of Chinese governance model, a kind of deep-rooted emotional prejudice, which reminds us to guard against such a long-standing existence. It will also continue to exist for a long time: because of the emotionalization of observation and research, people's understanding and understanding of China's governance model (including the Chinese legal system) is often in a narrow state of blind people's feeling. That is to say, it is simple to generalize the practice of China's legal system by "unable" and "anti-law" or "super-law". Ignoring the "law" is the basic form of Chinese social governance. The "Orientalism" of law not only makes us misread China in knowledge. It also misleads Chinese and foreign politicians in policy. This paper calls for a rational treatment of the coexistence of four phenomena in the practice of China's legal system, namely, the inability, the existence of law, the opposition to law, and the transcendence of law.
