道德争议的治理难题——以法律道德主义为中心

【摘要】：道德争议的本质是社会成员对做出某一行动的道德理由的对与错存在理性分歧,具有元理论、规范理论和教义学理论的三重实践意涵。在元理论层面,道德争议涉及关于伦理确定性的实在论与反实在论之争。在规范层面,道德争议在二阶的政治道德结构中引发了中立的自由主义与政治至善主义之间的对立。基于共同善的法律道德主义主张国家应当以法律制度的形式促进和保障人们更好地参与和实现共同善,为道德争议难题的解决提供了一个二阶的道德总纲。在教义学层面,公序良俗原则可被重构为法律道德主义的文化重塑功能,而不道德行为的犯罪化是国家以刑法对阻碍共同善行为的回应。法律道德主义为道德争议的法律治理提供了文化上保守、规制上宽容的理论方案。
[Abstract]:The essence of moral dispute is that the members of the society have rational differences on the right and wrong of the moral reasons for a certain action, and have the triple practical meaning of meta-theory, normative theory and doctrinal theory. Moral controversy involves the controversy between realism and anti-realism about ethical certainty. Moral disputes in the second order of political and moral structure led to a neutral liberalism and political supremacy of the opposition. Based on the common good of the legal moralism claims that the state should promote and protect people in the form of a legal system. We better participate in and achieve the common good. It provides a second-order general outline of morality for the solution of moral disputes. At the level of dogmatics, the principle of public order and good custom can be reconstructed into the function of cultural remolding of legal moralism. The criminalization of immoral behavior is the response of the state to the obstruction of common good behavior by criminal law. Legal moralism provides a theoretical scheme of cultural conservatism and tolerance for the legal governance of moral disputes.
