【摘要】:雅典的立法者从法律的角度锻造了一个令后世敬仰的城邦共同体。德拉古立法抑制了贵族们的僭主意图,使得城邦立法惠及城邦全体成员。梭伦通过立法让正义进入城邦,他赋予了公民中的弱势者以参政权和审判权,让他们更多地参与城邦公共事务。他也抑制了权贵们的傲慢,使其才能能够更好地施惠于城邦。克利斯提尼通过立法把公民权与平等权确立了下来,民众在政治上和法律上都享有极大的权力,雅典民主政体得以确立。埃菲阿特立法限制了最高法庭议事会的权力,把其全部权力赋予民众。这一系列的立法铸就了雅典特有的完全以城邦为依归的公民精神。于是,在这种法治精神的感召下,权贵们丢掉了自身的傲慢,全身心地融入到了民主政体中。民众也能接触到并享有贵族们的文化,从而提升了自身的品行。
[Abstract]:Lawmakers in Athens forged a legal community of city-states. Draghu legislated against the aristocrats' blasphemy. Make the city state legislation to benefit all members of the city. Solon through legislation to allow justice into the city, he gave the weak citizens to participate in power and jurisdiction. Let them participate more in the public affairs of the city-states. He also restrained the arrogance of the powerful, so that they could better benefit the city-states. Kristini passed legislation to establish the rights of citizenship and equality. The people enjoyed great political and legal power, and the Athenian democracy was established. Effiarte legislated to limit the power of the Supreme Court Council. Give all its power to the people. This series of legislation molded the unique Athenian civic spirit based entirely on the city-state. Therefore, under the inspiration of this spirit of rule of law, the dignitaries lost their arrogance. The people were able to touch and enjoy the culture of the aristocrats, thus enhancing their character.

【正文快照】: 引言 雅典在现代人心目中的地位是无与伦比的,这块土地上所产生的思想也一直是后学取之不尽的源泉。但学者们,尤其是法律学人,在对雅典社会的解读中却长期冷落雅典法律,究其原因,也许对法学家来说,在哲学领域中雅典人是罗马人的老师,但在法律领域中,罗马人则是希腊人的老师。
