“以德治国”与“中国特色社会主义法治体系”

【摘要】：法治与德治的关系,不仅是哲学、伦理学和法学领域的学术问题,也是国家治理领域的政治问题。"以德治国"是在批判地继承中国传统"德治"思想的基础上提出来的治国方略。"中国特色社会主义法治体系"是党的十八届四中全会正式提出的全面推进依法治国的总目标。对"以德治国"这一重要思想的深入探讨,以及当前加快构建中国特色社会主义法治体系,全面推进依法治国,建设社会主义法治国家,有着重要的理论和现实意义。从分析传统中国处理德刑关系的历史经验入手,以法治与德治的关系为主线,重点论述"以德治国"在"中国特色社会主义法治体系"建构中的启示,在此基础上强调"法德兼治"符合当代中国法治需求。
[Abstract]:The relationship between the rule of law and the rule of virtue is not only an academic issue in the fields of philosophy, ethics and law. It is also a political problem in the field of national governance. "ruling the country by virtue" is a strategy put forward on the basis of critically inheriting the traditional Chinese thought of "rule of virtue". "Socialist legal system with Chinese characteristics" It is the general goal of promoting the rule of law in an all-round way, which was formally put forward by the fourth Plenary session of the 18 Central Committee of the Communist Party of China. And the current speed up the construction of the socialist legal system with Chinese characteristics, comprehensively promote the rule of law, building a socialist country ruled by law. It has important theoretical and practical significance. From the analysis of the historical experience of traditional Chinese handling the relationship between morality and punishment, the relationship between the rule of law and the rule of virtue is the main line. This paper focuses on the enlightenment of "ruling the country by virtue" in the construction of "socialist legal system with Chinese characteristics", and on this basis emphasizes that "France, morality and governance" accord with the needs of contemporary Chinese rule of law.
