论唐律礼法关系对构建和谐社会的启示

【摘要】:《唐律疏议》作为中华法系代表的封建法典,其中蕴含了诸多古代仁人智士的智慧结晶,其已经不仅仅是一部单纯意义上的法典,更是对古代封建社会生产关系的高度浓缩,对封建社会意识形态的一个集中体现。对《唐律》进行深入研究,是每一个法律史工作者必须完成的课题。 在诸多针对《唐律疏议》的研究文献中,对其中所体现的礼法关系,众多学者的观点可谓众说纷纭。但总体而言,研究的深度仅及于礼法关系的本身,对其所体现的礼法关系对现实社会的借鉴言之不多。研究的观点包括礼是法的指导原则;礼直接入法;法是礼的具体表现,等等。 应该说,《唐律疏议》中体现的礼法关系,体现了儒家思想的精髓,蕴含了古代智者将道德与法律进行了完美结合的经验。自从西汉时期,统治者采纳“罢黜百家,独尊儒术”以来,儒学经学开始兴起,儒家所倡导的礼开始制度化,礼教文化开始深入人心。其间,虽经历朝代变迁,但儒家礼教的思想已扎根于整个社会,随着在南北朝时期礼的进一步完善和制度化,在唐代终于形成完备的五礼制度,成为调整各种社会关系的统治工具。故后世谓《唐律疏议》“一准乎礼”实乃客观使然。 《唐律疏议》中体现的礼法关系对我们构建和谐社会有着积极的启示意义。一方面,我们所倡导的社会主义核心价值理念与我国的传统儒家思想密不可分,儒家思想与以“八荣八耻”为内容的核心价值体系是内在契合的;另一方面,构建和谐社会也是构建法治社会的过程,《唐律疏议》将礼与法律的成功结合,也为我们在处理道德与法律的关系上提供了若干可以借鉴的经验。 本论文除了引言和结语部分以外,可以分为四大部分。 第一部分,礼的起源及礼法关系。首先,探讨了礼的起源和变迁,指出礼源于原始社会的交易规则,后经统治者的异化,成为具有调整社会关系的具有详细内容的规则制度。其次,探讨了中国古代社会礼法结合的历史传统和进程,指出礼与法共同作为统治工具二者之间具有的天然联系。 第二部分,《唐律疏议》中的礼法关系探析。首先,对唐代的礼与前朝的礼加以区别,指出礼在前朝经过儒学经学的普及和五礼制度的不断完善,在唐代达到了完备的地步,唐代的礼已经调整到社会关系的各个方面。其次,对《唐律》“一准乎礼”阐述了自己的观点,即“一准乎礼”不是立法技术造成,也不是统治者政策使然,而是因唐礼的完备性使得法律的调整也被纳入礼的范围,是客观使然。 第三部分,《唐律疏议》中的礼法关系对构建和谐社会的启示。首先,对唐律中的礼法关系去其糟粕,取其精华,提炼其中的积极部分,指出儒家思想如何与法律相得益彰的。其次,探讨了唐律中体现的礼法关系对构建和谐社会的启示意义,共两大方面,一是如何将儒家思想与社会主义核心价值体系相结合;二是借鉴儒家通过经学的兴起,将儒家思想深入人心,从而使法律中也能很好的融入道德内容的做法,探讨了当代法治建设中如何处理好道德与法律的关系问题。

Is the guiding principle of law the points include Li Li; direct access method; method of specific performance, ceremony and so on.
It should be said that the "tanglvshuyi etiquette relations embodied", embodies the essence of Confucianism, contains the ancient wise law and ethics will be the perfect combination of experience. Since the Western Han Dynasty, the rulers adopted "deposed 100, only Confucianism", Confucianism classics began to rise, advocated by the Confucian ritual start system the Confucian culture, began to popular. Meanwhile, although the experience of dynastic changes, but Confucianism thought is deeply rooted in the whole society, with the further perfect and systemized ceremony of the northern and Southern Dynasties in the Tang Dynasty, and finally formed a complete five rites system, become the dominant tool to adjust all social relations. "Tanglvshuyi reflected in the relationship between Li and Law > has a positive significance for us to build a harmonious society. In addition to the introduction and conclusion part, this paper can be divided into four parts.
The first part, the origin of etiquette and etiquette.
