论公民法律素质的基本要素及其提升路径

【摘要】：法律的权威源自人民的内心拥护和真诚信仰,人民是全面推进依法治国、构建法治社会的主体和力量源泉,公民法律素质的高低在很大程度上决定了法治中国建设的成败。从现实层面看,我国公民法律素质与法治社会的要求还存在较大差距,"信访不信法""信权不信法"等现象时有发生,"大闹大解决,小闹小解决,不闹不解决"的思维普遍存在,因此,全面推进依法治国的民众基础还有待进一步夯实。公民法律素质的提升应当围绕法律认同、法律信任、法律敬畏、法律践行能力四个方面的基本要素展开。法律认同是法律素质提升的前提,法律信任是法律素质提升的精神动力,法律敬畏是法律素质提升的核心,法律践行能力是法律素质提升的落脚点。
[Abstract]:The authority of the law originates from the people's inner support and sincere belief, and the people are the main body and source of strength to advance the rule of law in an all-round way and to build a society ruled by law. To a large extent, the legal quality of citizens determines the success or failure of the construction of China under the rule of law. There is still a big gap between the legal quality of citizens in our country and the requirements of a society ruled by law. The phenomena of "letter and visit not to believe" and "the right to believe or not to believe" occur from time to time. The promotion of citizens' legal quality should revolve around legal identity, legal trust, and legal awe. The legal identity is the premise of improving the legal quality, the legal trust is the spiritual motive force of the legal quality enhancement, and the legal awe is the core of the legal quality enhancement. The ability of legal practice is the foothold of improving the quality of law.
