因俗而治下的司法判决执照论析——以清末甘肃循化厅少数民族诉讼为视角

【摘要】：在清末,循化厅在因俗而治的理念下,在尊重少数民族两造传统的基础上,在动员乡老等积极参与下,依据番例番规制定判决执照。执照是确定少数民族两造双方产权纠纷及赔付标准的最重要依据。本文通过对循化厅少数民族判决执照的专题探讨,不仅了解了官府制定与颁发执照的程序,也知晓了官府制定执照时的策略与技巧,更明白了执照的民族与地域特色,亦洞悉了执照在消弭两造纠纷,稳定社会秩序方面的积极作用。
[Abstract]:At the end of the Qing Dynasty, the Xunhua Hall, under the idea of governing because of vulgarity, respected the traditions of the two ethnic groups, and actively participated in the mobilization of the township elders. The license is the most important basis to determine the dispute of property right and the standard of compensation between the two sides of minority nationality. He not only understood the procedure of making and issuing licenses by the government, but also knew the strategies and techniques used by the authorities in making licences, understood the ethnic and regional characteristics of the licenses, and also knew that the licenses were eliminating disputes between the two sides. A positive role in stabilizing social order.
