楼市“限购令”背后的法经济学原理

【摘要】:房地产价格的高低直接关系到每个家庭是否能获得自己具有完全产权的房屋,也是保证居民享有宪法上的“居住权”的前提。楼市“限购令”出台的目的就是为了抑制房地产市场价格快速上涨的势头,促使房地产市场价格的合理回归。房地产价格是关系到普通居民能否以自身的经济实力取得房屋的所有权的问题,过高的房价会促使财富的不合理集中,同时也不利于社会的稳定和经济的快速健康发展。 之前研究楼市“限购令”的文献多是从楼市“限购令”的合法性和合理性的角度来进行法律分析,本文试图从法经济学的角度上对楼市“限购令”背后的法经济学原理进行阐释,从另一个不同的视角利用经济学的分析工具来对楼市“限购令”进行作者视角的独特分析,以求为楼市“限购令”找到法经济学上的理论支撑,同时提出自己对于楼市“限购令”政策走向的分析和建议,希望为促使房地产价格的合理回归建言献策。这也是本文创作上的创新之处。 本文总体结构上分为三大块,第一大块从总体上进行综述楼市“限购”政策;第二大块分别是利用法经济学上的分析工具对楼市“限购”政策进行分析阐释,以求找到其背后的法经济学原理,同时分析楼市“限购”政策的实施效果和法律上的正当性分析;第三大块主要是针对楼市“限购”政策所遭受的非议和质疑,为其找到政策的走向和发展预测建议。 具体的说文章分为六个部分,第一部分是对楼市“限购”政策作简单的论述,明确其政策性质和定位;第二部分和第三部分主要是分别分析楼市“限购令”出台的法经济学上的微观原因和宏观条件;第四部分着重从法经济学上对楼市“限购”政策出台后所达到的政策效果进行法经济学上的理论分析;第五部分是从楼市“限购令”的合理性和正当性上进行分析,提出作者对于楼市“限购”政策的倾向性观点;最后第六部分是对于楼市“限购”政策的政策走向和如何延续提出自己的预测和政策走向建议,力图使得楼市“限购令”更好的发展,更好的为促使房地产价格的合理回归而努力。
[Abstract]:The price of real estate is directly related to whether every family can obtain their own house with full property right. It is also a prerequisite for residents to enjoy the constitutional "right of abode." the purpose of the "purchase restriction order" in the property market is to curb the rapid rise in real estate prices. Promote the reasonable return of real estate market prices. Real estate prices are related to whether ordinary residents can obtain ownership of their houses with their own economic strength. Excessive housing prices will promote the unreasonable concentration of wealth. At the same time, it is not conducive to social stability and rapid and healthy economic development. Most of the previous studies on the "purchase restriction order" in the property market were based on legal analysis from the perspective of the legality and reasonableness of the "purchase restriction order" in the property market. This paper attempts to explain the principle of law and economics behind the "purchase restriction order" in the property market from the angle of law and economics, and makes a unique analysis of the "purchase restriction order" in the property market from another angle of view, using the analysis tool of economics. In order to find the theoretical support in law and economics for the "purchase restriction order" in the property market, at the same time, it puts forward its own analysis and suggestions on the direction of the "purchase restriction order" policy in the property market. Hope to promote the reasonable return of real estate prices, which is the innovation of this article. The overall structure of this paper is divided into three parts: the first is a general review of the "limited purchase" policy in the real estate market; the second is to analyze and explain the "limited purchase" policy of the real estate market by using the tools of law and economics. In order to find out the principle of law and economics behind it, and at the same time to analyze the effect of the implementation of the "limited purchase" policy in the real estate market and the legal legitimacy analysis; the third part is mainly aimed at the criticism and query of the "limited purchase" policy in the property market. To find out the direction of policy and development forecast recommendations. Specifically, the article is divided into six parts, the first part is to make a simple discussion of the property market "limited purchase" policy, clear its policy nature and positioning; The second part and the third part mainly analyze the microcosmic reasons and macro conditions of the law and economics of the "purchase restriction order" in the real estate market. Part 4th focuses on the theoretical analysis of the policy effect achieved after the introduction of the "limited purchase" policy in the real estate market from the point of view of law and economics, while part 5th analyzes the rationality and legitimacy of the "purchase restriction order" in the property market. This paper puts forward the author's opinion on the tendency of the "limited purchase" policy in the real estate market, the last 6th part is about the policy direction of the "limited purchase" policy of the real estate market and how to continue to put forward his own forecast and suggestions on the direction of the policy direction. Try to make the property market "purchase restrictions" better development, better to promote a reasonable return of real estate prices and efforts.
