法科大学生法律信仰问题研究

【摘要】：法律信仰是我国实现依法治国基本方略的内在要求,是事关社会主义市场经济能否健康运行,民主法治能否最终实现的重要因素。没有法律信仰的法治社会是没有灵魂的社会,人人不依法办事,经济文化政治秩序紊乱。法律信仰的主体之一是法科大学生,他们的法律信仰有无乃至强弱直接影响着中国未来的法治进程。由此可见,对其法律信仰问题进行研究很有必要。本文在法学、思想政治教育学的理论框架下采用文献研究法、矛盾分析法、社会学研究方法以及定性分析法等方法对法科大学生的法律信仰问题进行研究。全文由四个部分组成:绪论、法律信仰问题概述、法科大学生法律信仰的现状的实证分析以及提高法科大学生法律信仰的路径。各部分主要内容介绍如下: 第一章绪论绪论主要由两部分组成:选题的原因、目的及本文研究的理论视角和基本方法。第二章法律信仰问题概述该章节分两大部分对法律信仰问题进行阐述。第一部分是关于信仰相关问题的概述,在对国内学术界对于信仰的定义进行总结之后对信仰进行历史分析。第二部分是法律信仰基本问题的概述。本文将法律信仰定义为主体对自己生活状态下国家法律产生崇敬依赖之情,进而形成坚定法律信念,并在此基础上合理行为,将法律作为自身的行为准则的一种精神状态,是主体的一种自我意识。法律信仰形成离不开客观和主观条件,它的存在有利于社会主义市场经济的健康运行,有利于抑制腐败,净化社会风气,有利于法治社会的实现。第三章法科大学生法律信仰的现状实证分析本文采用实证分析的方法,结合个案访谈、小型座谈以及问卷调查的方式对华东政法大学全日制本科生进行了调查并对调查结果进行了分析。本次调查得出的主要结论法科是法科大学生对法律的基本精神较为认同,但大学生对法律的实用性功能方面的关注胜于其对其精神层面作用的关注,对法律信仰问题的认识不足。影响法科大学生法律信仰的因素主要有社会环境的影响、中国高等法学教育体制的影响以及家庭、大学生自身的影响等。第四章构建法科大学生法律信仰之路径针对法科大学生法律信仰的有关特点,本章对提高法科大学生法律信仰提出相关对策,分别是尊重法律权威性,建设尚法崇法环境;准确定位法律院校培养目标,培养大学生法律信仰和重视理论与实践结合,提升法科大学生法律信仰。
[Abstract]:Legal belief is the internal requirement of realizing the basic general plan of governing the country according to law in our country, and it is an important factor related to the healthy operation of socialist market economy and the ultimate realization of democracy and rule of law. A society ruled by law without legal belief is a society without soul. Everyone does not act according to law, and the economic, cultural and political order is in disorder. One of the main bodies of legal belief is the students of the University of Science and Technology of Law. Whether or not their legal beliefs have or not have a direct impact on the future process of the rule of law in China can be seen from this. It is necessary to study its legal belief. In this paper, under the theoretical framework of law and ideological and political pedagogy, literature research method and contradiction analysis method are used. The methods of sociological research and qualitative analysis are used to study the legal belief of the students of the University of Science and Technology. The full text is composed of four parts: introduction, Overview of legal belief, An empirical analysis of the present situation of the legal belief of the students of the University of Science and Technology and the way to improve the legal belief of the students of the University of Science and Technology. The main contents of each part are as follows:. Chapter one introduction. The introduction consists of two parts: the reason, the purpose, the theoretical perspective and the basic methods of this study. Chapter II Overview of legal belief. This chapter is divided into two parts to elaborate the legal belief. The first part is an overview of faith-related issues. The second part is an overview of the basic issues of legal belief. This paper defines legal belief as the subject of their own living state of the state of state law. The law produces a feeling of reverence and dependence, Therefore, it is a kind of self-consciousness for the subject to form a firm legal belief and act reasonably on the basis of which the law is regarded as a kind of spiritual state of one's own code of conduct, and the formation of legal belief can not be separated from objective and subjective conditions. Its existence is conducive to the healthy operation of the socialist market economy, the suppression of corruption, the purification of social ethos, and the realization of a society ruled by law. The third chapter: an empirical analysis of the present situation of the legal beliefs of the students of the University of Law Science and Technology. This paper uses the method of empirical analysis, combined with case interviews, A small discussion and a questionnaire survey were conducted to investigate the full-time undergraduates of East China University of political Science and Law, and the results were analyzed. The main conclusion of this survey is that the students of the University of Law and Science agree with the basic spirit of law. However, college students pay more attention to the practical function of the law than to its spiritual role, and lack of understanding of the legal belief. The main factors that affect the legal belief of the students in the University of Law Science and Technology are the influence of the social environment. The influence of Chinese higher law education system and the influence of family and college students themselves. The way of constructing the legal belief of the students in the University of Law and Technology in Chapter 4th. In view of the characteristics of the legal beliefs of the students of the University of Science and Technology, this chapter puts forward the relevant countermeasures to improve the legal beliefs of the students of the University of Law Science and Technology, which are to respect the authority of the law, to build the environment of law worship, and to accurately locate the training objectives of the law colleges and universities. Cultivate college students' legal belief and attach importance to the combination of theory and practice, promote the law belief of law university students.
