英国大学法学教育国际化的起源及其流变

【摘要】：大学法学教育国际化,是近20年来中国教育界一直在探索的热点,既是中国法学教育改革的目标之一,也是贯彻实施当前"一带一路"之国家倡议的必然要求。总结历史上法学教育国际化的经验和成果,是开展好这一事业的重要途径。11世纪前后出现的"罗马法复兴"运动导致了中世纪大学的诞生,英国牛津大学与剑桥大学的兴起推动了大学法学教育国际化的开展。尽管在英国法学教育中,罗马法的传授经历了曲折过程,但仍是唯一自中世纪教授至今的科目。罗马法教授在英国法学高等教育中的发展过程,体现了法学教育的国际化进程,即在吸收欧洲大陆法学研究成果的同时保持了英国本土法律教育的特色,从而使英国成为近代以后法律教育的强国之一。
[Abstract]:The internationalization of university law education has been a hot topic in the field of education in China in the past 20 years. It is also one of the goals of the reform of law education in China. It is also an inevitable requirement for the implementation of the current national initiative of "Belt and Road." summarizing the experience and achievements of the internationalization of legal education in history, Is an important way to carry out this cause. The "revival of Roman law" around the 11th century led to the birth of medieval universities. The rise of Oxford University and Cambridge University promoted the internationalization of university law education, although the teaching of Roman law went through a tortuous process in English law education. However, it is still the only subject that has been taught since the Middle Ages. The development of Roman law professors in the higher education of law in England reflects the internationalization of law education. That is, while absorbing the achievements of continental European legal research, it maintains the characteristics of English native law education, thus making Britain one of the powerful countries in legal education after modern times.
