中国与欧盟食品安全法律制度比较研究

【摘要】：“民者国之本,食者民之命也”,但当食品安全无法获得保障时我们将何处安生?我国食品安全事故日益频发,折射出安全制度中的结构性缺陷和问题。值得欣慰的是2009年颁布的《食品安全法》,在一定程度上缓解了我国过去食品不安全问题,其实施过程中也取得了一定的成效。2015年我国对《食品安全法》80%的条款进行了修改,很大程度上改善了食品安全制度中监管中多头执法和监管权责不明等诸多问题,但仍存在有不足之处。作为当今世界上食品安全法律制度比较发达的国际区域组织--欧盟,其食品安全法律制度最具有代表性。欧盟用了近半个世纪的时间,建立并完善“从农田到餐桌”全流程食品安全规范,其在制度的构建和运行已经达到世界较高的水平。笔者期待通过对比的方法,将中欧二者的食品安全规范以及制度进行全面梳理、深入研究,阐释剖析我国食品安全法律制度问题所在,并提出和论证适合我国国情的具体对策建议。在本文中,笔者主要分为三个部分进行论述,第一部分对国际食品安全法律制度进行大概的介绍。第二部分主要是比较中国与欧盟食品安全法律制度二者异同之处。以法律体系、食品标准、监管、责任的承担、转基因食品安全五个方面为切入点进行比较,明晰我国目前的问题及困境。第三部分,基于前面对比考察,对我国食品安全法律制度进行反思性研究,提出完善性的规范建议。
[Abstract]:"the people are the foundation of the country, and the life of the people is the life of the people." but when food security is not guaranteed, where will we live?. The increasing frequency of food safety accidents in China reflects the structural defects and problems in the safety system. It is gratifying to note that the Food Safety Law promulgated on 2009 alleviates to a certain extent the past food insecurity in China. In 2015, China amended the provisions of the Food Safety Law 80%, which to a large extent improved the many problems in the food safety system, such as the multiple enforcement of the law and the unclear powers and responsibilities of the supervision, and so on. However, there are still some shortcomings. As an international regional organization with relatively developed food safety legal system in the world today, the European Union has the most representative food safety legal system. The EU has spent nearly half a century. The establishment and improvement of "from farmland to dining table" whole process food safety norms, its construction and operation in the system has reached a higher level in the world. The food safety norms and systems of China and Europe are comprehensively combed, deeply studied, the problems of food safety legal system in China are explained and analyzed, and specific countermeasures and suggestions suitable for China's national conditions are put forward and demonstrated. The author mainly divides into three parts to carry on the elaboration, the first part carries on the general introduction to the international food safety legal system. The second part is mainly compares the similarities and differences between China and the European Union food safety legal system. Five aspects of food standards, supervision, responsibility and safety of genetically modified foods are compared to clarify the current problems and dilemmas in China. The third part, based on the previous comparative investigation, This paper makes a reflective study on the legal system of food safety in China and puts forward some suggestions for perfection.
