软法在推进国家治理现代化中的作用

【摘要】：随着国家治理现代化的推进,软法的作用越来越受到人们的重视,我国国家治理领域中的软法形式越来越丰富。目前最主要的形式有七种:一是公法的基本原则;二是已经形成和正在形成的宪法和行政法惯例;三是执政党的党内法规;四是宪法、法律中的宣示性、倡导性条款;五是已经形成和正在形成的公民社会规则;六是司法判例;七是行政执法基准。这些形式的软法对于规范国家公权力的行使,推进依法治国;规范执政党的行为,推进依法执政;规范政府行政行为,特别是行政裁量行为,推进依法行政和法治政府建设;规范公民社会行为,推进参与民主和协商民主以及平衡改革、发展、创新与法治的关系,保障富强中国、民主中国和法治中国建设的协调统一均有着特殊重要的意义和作用。
[Abstract]:With the advancement of the modernization of national governance, people pay more and more attention to the role of soft law, and the forms of soft law in the field of national governance are more and more abundant. At present, there are seven main forms: first, the basic principles of public law; Second, the constitution and administrative law convention which has formed and is forming; third, the ruling party's inner-party regulations; fourth, the constitution, the declaration in the law, the advocacy clause; fifthly, the civil society rule that has formed and is forming; sixth, the judicial precedent; Seventh, administrative law enforcement benchmarks. These forms of soft law can regulate the exercise of the public power of the state and promote the rule of law; standardize the behavior of the ruling party and advance the rule of law; and standardize the administrative acts of the government, especially the administrative discretion. To promote the building of a government governed by law and the rule of law; to standardize the behavior of civil society; to promote participatory democracy and consultative democracy; and to balance the relationship between reform, development, innovation and the rule of law, so as to ensure a prosperous and strong China. The harmonious and unified construction of democratic China and China ruled by law has special significance and function.
