法律强制力观念的弱化与法家思想的时代性危机——一个初步的批判与阐释

【摘要】：思考先秦法家的历史意义和当代价值,应立基于中国法理学的语境。倘若"法律的强制力观念弱化"作为中国法理学语境中的强势话语能成立的话,那么,以"严刑重罚"和"以刑去刑"为核心主张的先秦法家思想,其合理性与价值就会面临根本性挑战。而事实上,所谓"法律的强制力观念弱化"只是一个虚幻的法学乌托邦。强制力和威慑性仍然是法律的核心要素和本质特征,因此先秦法家思想的核心理念并没有受到实质性冲击。对于当下"全面推进依法治国"和提升国家治理现代化而言,先秦法家思想仍然具有积极启示意义。
[Abstract]:Considering the historical significance and contemporary value of the Legalists in the Pre-Qin Dynasty, we should base on the context of Chinese jurisprudence. If the "weakening of the concept of the coercive power of law" can be established as a strong discourse in the context of Chinese jurisprudence, then, The rationality and value of the thought of "severe punishment" and "taking punishment away from punishment" as the core ideas of the pre-Qin legalists will face a fundamental challenge. The so-called "weakening of the concept of legal compulsion" is just an illusory legal utopia. Coercive force and deterrence are still the core elements and essential features of the law. Therefore, the core idea of the thought of Legalists in the Pre-Qin Dynasty has not been substantially impacted, and it is still of positive significance to "comprehensively promote governing the country according to law" and to promote the modernization of national governance.
