【摘要】：宋代的法医制度继承了前代的司法鉴定理论和实践成果,并加以损益,形成了法医制度的基本体系。宋代法医制度在理论实践层面成为我国古代法医制度中里程碑式的存在。宋慈所著《洗冤集录》更是把这一时期的司法鉴定水平提高到更高的层次,对后世影响深远。本文主要论述了我国古代法医的演进过程,介绍了自先秦时期开始,我国法医学历经秦汉,盛唐直至宋代的发展脉络,并对各个时期法医制度的发展概况进行阐释。宋代经济发达、对外开放、科技水平高、推行文官制度等一系列因素使得宋代成为国古代法医发展的黄金时期,宋代法医制度相较前代有了长足的发展,主要表现为宋代法医的职官制度,确立了以司理参军、县尉为主,仵作行人、司法吏为辅的法医检验群体;明确了法医检验工作的基本内容,包括现场勘验、尸体检验,调查访问等。宋代法医制度在职业化和规范化方面取得了突出的成绩,专业的检验人员、规范化的操作流程、清晰的检验文书,宋代法医制度的发展在一定程度上扭转了我国古代司法活动中重实体,轻程序的局面。在司法活动中,司法官员在尊重实体公正的前提下,开始关注案件的程序公正,这对于我国古代司法活动的发展是一个十分巨大的进步。
[Abstract]:The forensic system of the Song Dynasty inherited the theory and practice of judicial expertise of the previous generation and made gains and losses. The system of forensic medicine in Song Dynasty has become a milestone in the practice of forensic medicine in ancient China. Song ci's Collection of Remembrance of grievances is a reference to the level of forensic expertise in this period. To a higher level, This paper mainly discusses the evolution process of forensic medicine in ancient China, and introduces the development of forensic medicine in China from the pre-Qin period to the Song Dynasty, which has experienced the Qin and Han dynasties, the prosperous Tang Dynasty and the Song Dynasty. A series of factors, such as developed economy, opening to the outside world, high level of science and technology and the implementation of civil service system, made the Song Dynasty a golden period for the development of ancient forensic medicine. Compared with the previous dynasties, the forensic system of the Song Dynasty has made great progress, mainly manifested in the official system of the forensic medicine in the Song Dynasty, and established the forensic medical examination group, in which the chief officer joined the army, the county lieutenant was the chief officer, the coroner was the pedestrian, and the judicial official was the assistant. The basic contents of forensic examination are clarified, including on-site examination, cadaver examination, investigation visit, etc. The forensic medical examination system of Song Dynasty has made outstanding achievements in professionalization and standardization, professional examiners, standardized operation process, etc. The development of the forensic medicine system in the Song Dynasty to a certain extent reversed the situation of valuing the entity rather than the procedure in the ancient judicial activities of our country. In the judicial activities, the judicial officials, on the premise of respecting the justice of the entity, Beginning to pay attention to the procedural justice of cases is a great progress for the development of judicial activities in ancient China.
