威宁赫章交界地区彝族婚姻习惯法调查研究

【摘要】：依法治国是我国现当代的一大主题,一个国家的根本之处也在于法制。这既要求我们做到对国外法治理论和他们成功经验的借鉴和吸取,更要求我们要对我国之国情的熟悉和了解,总结现有的、本土的法律资源,从历史和现实中去发现、掌握、研究,以此来奠定法治发展的基础。然而在中国的大地上少数民族习惯法毫无疑问是不可忽视的部分,在贵州威宁赫章交界地区彝族婚姻习惯法便是不可回避的部分。在我国,云南、贵州、四川是彝族的主要分布之处。根据我国第六次人口普查的统计数据,在贵州省境内彝族所占比例是全省的2.4%,共有人口83.45万人,在全省的少数民族人口中所占的比例是6.65%,大多数都分布在贵阳市、毕节市、安顺市、六盘水市,在黔西南自治州也居住着小部份彝族。本文所选的彝族聚居地区是威宁赫章交界地带,这里是贵州境内出了名的高寒地区。这里地势陡峭,山峦叠嶂,到处都是高山峻岭,赫章的韭菜坪,是全省的最高峰,其海拔高度达2900多米。彝族习惯法就是彝族在长期的社会生活中用来惩恶扬善的法规法纪。它涉及彝族社会生活的各个方面,虽然没有文字条款,但按习惯对犯罪行为、违反道德规范的人和事予以制裁。在彝法(乌撒彝族对法律法规的总称)中占主导地位,对彝族社会经济的发展、道德行为规范起着积极的作用。本文立足于彝族婚姻习惯法的动态空间,深入到彝族村落中去,调查掌握现实生活中已经发生变化的和正在发生变化的彝族婚姻习惯法,研究总结威宁赫章交界地区彝族婚姻习惯法,希望我的调查研究可以帮助到一些少数民族边远地区的法制建设。本篇论文除了摘要和结语两个部分,总共分为五个部分。第一是绪论,本部分主要对选题的理由和意义、研究现状,对田野调查、历史分析等研究方法以及对调查点的概况进行介绍,最后对相关的基本概念作出界定。第二是彝族家支与婚姻习惯法的关系,本部分是为了第三章和第四章的写作做铺垫,主要介绍彝族家支、彝族家支习惯法的基本内容,最后针对彝族家支和婚姻习惯法的关系作系统分析。第三是彝族婚姻习惯法,本部分主要描述和分析威宁赫章交界地区彝族婚姻习惯法,在威宁赫章交界地区彝族习惯法里至今保存较为完善的习惯法制度无疑是彝族婚姻习惯法,本部分主要分析和描述彝族婚姻的缔结原则、婚姻的缔结形式和结婚程序。第四是婚姻纠纷调解制度,本部分描述和分析威宁赫章交界地区彝族传统的婚姻纠纷调解制度,分别介绍民间调解人“布摩”、婚姻纠纷调解形式以及纠纷调解制度的特点和意义。第五是彝族婚姻习惯法的分析与展望,本部分主要是分析总结威宁赫章地区彝族婚姻习惯法的特征,其次是分析彝族婚姻习惯法对威宁赫章地区法制建设的影响;最后总结威宁赫章地区彝族婚姻习惯法的发展和对研究威宁赫章地区彝族婚姻习惯法意义的思考。
[Abstract]:The rule of law is a major theme of contemporary, fundamental of a country lies in the legal system. This requires us to do on the foreign legal theories and their successful experiences and lessons, it requires us to the situation in our country is familiar with and understand the existing legal resources, to local. Found, master, research from history and reality, in order to lay the foundation of the development of the rule of law. However, in the land of Chinese minority customary law is no doubt part can not be ignored, the border area of Guizhou Weining Yi customary law of marriage in Hezhang is an unavoidable part. In China, Yunnan, Guizhou. Sichuan is the main distribution of Yi. According to the statistics of China's sixth census, in the territory of Guizhou Province, the proportion is 2.4% of the province, with a total population of 834 thousand and 500 people in the province, the minority population in the proportion of the Cases is 6.65%, most are located in Guiyang City, Bijie City, Anshun City, Liupanshui City, in Southwest Guizhou Autonomous Prefecture also inhabited by a small part of the Yi nationality. The Yi area is the Weining Hezhang border, here is the territory of Guizhou out of the alpine region. The steep mountain peaks, full of potential. Are Hezhang Jiucaiping, lofty mountains and steep hills, is the highest peak in the province, the altitude of 2900 meters. The customary law of Yi is in the long-term social life to punish the law. It relates to various regulations of Yi nationality life, although there is no text terms, but according to the habits of the crime, the violation of morality people and things should be punished. In Yi (Yi: method of laws and regulations in general) dominates the development of Yi society economy, moral norms play a positive role. This article bases on Yi marriage Dynamic space marriage customary law, into the Yi village to survey the changes have happened in real life and changing the Yi customary law of marriage, the research summed up the Weining Hezhang border region Yi customary law of marriage, I hope my research can help to the construction of legal system of some ethnic minorities in remote areas of this thesis. In addition to the two part of the summary and conclusion, is divided into five parts. The first is the introduction of this part of the main topics of the reason and significance of field investigation, research method, historical analysis and survey on the check are introduced, finally defines the related concepts. The second is the relationship between Jiazhi with the customary law of marriage, this part is to pave the way for the third chapter and the fourth chapter mainly introduces the writing, Jiazhi, basic content of Jiazhi customary law, according to the Yi The relationship between the family and the marriage customary law system analysis. The third is the Yi customary law of marriage, this part mainly describes and analyzes the Weining Hezhang border area of Yi customary law of marriage, the border area in Weining Hezhang Yi customary law has preserved a relatively perfect legal system is undoubtedly the habit of Yi customary law of marriage, this part mainly analyzes the conclusion principle and the description of Yi marriage, marriage and marriage procedure. Fourth marriage dispute mediation system, this part describes and analyzes the Weining Hezhang border area of Yi traditional marriage dispute mediation system, were introduced the "mediator Bumo", folk characteristics and significance of marriage disputes and mediation mediation system. The fifth is the analysis and the prospect of the Yi customary law of marriage, this part is mainly to analyze and summarize the characteristics of the Yi customary law of marriage in Weining Hezhang area, followed by the analysis of Yi The influence of marriage customary law on the construction of legal system in Hezhang area of Weining is summarized. Finally, the development of the marriage custom law of Yi people in Weining Hezhang area and the thinking of studying the meaning of marriage custom law of Yi people in Weining Hezhang area are concluded.
