中国特色社会主义法治道路基本特征研究

【摘要】：我国社会主义法治建设所取得的成功经验,就在于中国特色社会主义法治理论的形成发展,中国特色社会主义法治道路的成功开创,以及在这条道路上所取得的突出成就。在我国法治建设过程中,党领导人民将“依法治国、建设社会主义法治国家”确定为奋斗目标。坚持这条法治道路,是中国共产党的选择,是中国人民的选择,是历史的选择。对中国特色社会主义法治道路的基本特征予以分析和总结,对于探寻中国特色社会主义法治道路内在发展规律,推动我国法治建设进程,具有一定的重要意义。在本文的引言部分,对本研究的价值和意义进行分析,并阐述了国内外对于本研究领域的研究现状,同时,对本研究的目标与研究方法进行介绍。正文的第一部分对中国特色社会主义法治道路涉及的相关概念在一定程度上予以厘清,具体从法治、中国特色社会主义法治和中国特色社会主义法治道路三个概念进行分析,为论证中国特色社会主义法治道路的基本特征奠定理论基础。正文的第二部分从历史角度出发,对中国特色社会主义法治道路的发展进程进行回顾与详细阐述。这条法治道路是由几代中国共产党人不断探索、形成并发展创新的,为后续对其基本特征的详细分析与论证提供事实依据。正文的第三部分从理论上总结概括中国特色社会主义法治道路的基本特征。中国特色社会主义法治道路经过漫长而不是一蹴而就的发展,因而其形成发展呈现渐进式特征;这条法治道路的指导思想是一个庞大而全面的有机体系,具有鲜明的科学性特征;在这条法治道路建设过程中,中国共产党始终保持和发展马克思主义政党的先进性,带领中国人民坚定不移沿着这条法治道路前进,这充分体现了其领导主体具有先进性特征;要使该道路的最终目标得以实现,就要从各个方面保障人民当家做主的实现,因而其价值目标具有人民性特征。正文的第四部分对中国特色社会主义法治道路的发展前景进行展望。对这条道路的坚定不移,要充分结合该道路具备的基本特征,并要在兼收并蓄的基础上维持十足的定力,在国家主导与社会协同的同时保持发展的渐进平衡。在本文的结论部分,总结中国特色社会主义法治道路具有一定的基本特征,即:形成发展的渐进性,指导思想的科学性,领导主体的先进性,价值目标的人民性。
[Abstract]:The successful experience in the construction of socialist rule of law in China lies in the formation and development of the theory of the rule of law with Chinese characteristics, and the successful creation of the road of ruling by law with Chinese characteristics. In the process of building the rule of law in China, the people under the leadership of the Party set the goal of "ruling the country according to law and building a socialist country ruled by law." It is the choice of the Communist Party of China, the choice of the Chinese people, the choice of history. To analyze and summarize the basic characteristics of the road of ruling by law of socialism with Chinese characteristics, to explore the inherent development law of the road of ruling by law of socialism with Chinese characteristics, It is of great significance to promote the construction of the rule of law in our country. In the introduction part of this paper, the value and significance of this study are analyzed, and the present research situation of this research field at home and abroad is expounded, at the same time, The first part of the text clarifies the related concepts related to the road to the rule of law of socialism with Chinese characteristics to a certain extent, specifically from the rule of law, The three concepts of the rule of law of socialism with Chinese characteristics and the road of ruling by law with Chinese characteristics are analyzed in order to lay a theoretical foundation for the demonstration of the basic characteristics of the road of ruling by law with Chinese characteristics. Reviewing and expounding in detail the development process of the road of ruling by law of socialism with Chinese characteristics. This road of ruling by law was continuously explored by several generations of Chinese Communists and formed and developed and innovated. The third part of the text summarizes the basic characteristics of the socialist rule of law with Chinese characteristics. After a long time rather than a one-off development, The guiding ideology of this road of rule of law is a huge and comprehensive organic system with distinct scientific characteristics. In the course of the construction of this road of rule of law, The Communist Party of China has always maintained and developed the advanced nature of Marxist political parties and led the Chinese people to unswervingly advance along this road of rule of law, which fully reflects the advanced characteristics of its leading bodies. If the ultimate goal of the road is to be realized, it is necessary to guarantee the realization of ownership by the people in all its aspects. The 4th part of the text looks forward to the development prospect of the socialist road of rule of law with Chinese characteristics. The steadfastness of this road should be fully combined with the basic characteristics of the road. In the conclusion of this paper, the author summarizes that the road of socialist rule of law with Chinese characteristics has some basic characteristics. That is, the gradual development, the scientific guiding ideology, the advanced nature of the leading body and the people's character of the value target.
