论微观社会中的法治

【摘要】：从逻辑上,法治就是法作为主体对事务的治理,即“法的理念”治理。法治既涉及价值、理念、体制、制度等宏大问题,也涉及每个个人在微观社会中为人处世的原则。微观社会是以一个人为中心进行展开的生活,包括家庭生活、社团生活、工作关系。微观社会中的法治遵从的是老子所说的“道”。它不直接表现为具体的法律,但是它是法律、道德、习俗和其他调节人类关系规则的基本原则。由于微观社会中存在许多违背法治的现象并且这些现象并未被人们察觉,因此本文就从微观社会中违背法治的现象入手,探讨微观社会中的法治对策。论文从“法治”、“微观社会中的法治”的基本概念入手,分析与论述法治在微观社会中是如何发挥其重要作用的,在分析的基础上总结概括出微观社会中的法治领域。论文正是在这一基本逻辑基础上进行展开的论述。有关微观社会中违背法治的具体现象、微观社会中违背法治现象存在的原因以及微观社会中的法治对策的论述是论文的核心。从微观社会视角探索法治,寻找法治理念与人们具体生活衔接环节,反过来,从具体的生活法治实践关注法治建设;从微观社会的非法治走向法治,进而构成社会法治、国家法治的重要组成部分和重要内容;针对微观社会中非法治现象的对策研究,丰富了社会主义法治内涵。
[Abstract]:Logically, the rule of law is the governance of affairs by the law as the subject, that is, the governance of the concept of law. The rule of law not only involves such grand problems as value, idea, system, system, and so on. It also involves the principle that every individual acts as a person in a micro society. A micro society is a life centered on one person, including family life, community life, Working relationship. The rule of law in a microcosmic society follows what Laozi calls "Tao". It does not directly manifest itself in specific laws, but it is law, morality, Customs and other basic principles that regulate the rules of human relations. Since there are many phenomena that violate the rule of law in the micro society and these phenomena are not noticed by people, this article starts with the phenomenon of violating the rule of law in the micro society. This paper begins with the basic concepts of "rule of law" and "rule of law in micro society", and analyzes and discusses how the rule of law plays an important role in the micro society. On the basis of analysis, the author summarizes the field of rule of law in the micro society. The thesis is based on this basic logic to discuss the concrete phenomenon of violating the rule of law in the micro society. The core of the thesis is the discussion of the reason of violating the rule of law phenomenon in the micro society and the countermeasures of the rule of law in the micro society. Exploring the rule of law from the perspective of the micro society, looking for the link between the concept of the rule of law and the concrete life of people, and conversely, Focus on the construction of the rule of law from the concrete practice of life rule of law; from the micro-society non-rule of law to the rule of law, and then constitute the social rule of law, the national rule of law an important component and important content; micro-society non-rule of law phenomenon of countermeasures, It enriches the connotation of socialist rule of law.
