论法律的实际作者

【摘要】：立法者及其意图在法律实施过程中是否发挥着以及发挥着怎样的作用?用法者在法律生成的过程中又是否扮演着以及扮演着怎样的角色?对这两个问题的回答可以从不同角度进行。从法律的作者这一角度看,不仅仅立法者,用法者也实际上参与着法律的最终生成。因此,无论在法律实施还是法律生成的过程中,立法者与用法者实际上都是一种合作关系,也正是这种合作关系决定了他们都必得保持谦抑、克制。
[Abstract]:Do legislators and their intentions play a role in the implementation of the law? Does the user play a role in the process of law generation? From the perspective of the author of the law, not only the legislator, but also the user is actually involved in the final generation of the law. Legislators and usemakers are actually a cooperative relationship, which determines that they must be modest and restrained.
