公民网上言论自由权的法律规制研究

【摘要】：言论自由是宪法赋予公民的一项重要的基本权利,公民享有宪法赋予的言论自由权利也是一个民主、文明社会应有的重要标志。随着社会的进步与发展,尤其是互联网的快速发展和普及,公民网上言论自由权也理应是宪法所赋予公民的言论自由权的应有之意,公民网上言论自由权作为一项新兴的公民权利,其法律规制问题也是一个具有相当的探讨空间的课题。本文分为绪论、公民网上言论自由权的法律规制概述、我国公民网上言论自由权的法律规制现状及问题、国外公民网上言论自由权法律规制的经验、完善我国公民网上言论自由权法律规制的对策和建议、结论共六章：第一章,介绍了选题的目的和意义以及有关的研究成果及观点。第二章,主要从公民网上言论自由权的涵义、公民网上言论自由权法律规制的涵义、价值以及网络与网上公民言论自由权的关系方面对公民网上言论自由权进行了简要概述。第三章,从法律规范、一般性行政法律规范、技术性行政法律规范、公民与行业自律性规范几个方面对我国公民网上言论自由权的立法现状进行了介绍,并对以上方面所存在的问题进行了阐述和分析。第四章,从有关立法、健全的司法救济、灵活区别监管的执法理念、公民与行业自律等方面对国外网上言论自由权的法律规制经验进行了介绍。第五章,在借鉴国外有关经验的基础上,根据我国具体的实际情况,对于完善公民网上言论自由权法律规制的对策,在立法、司法、行政执法、公民与行业自律方面提出了具体的对策和建议。第六章是结论。
[Abstract]:Freedom of speech is an important basic right conferred by the Constitution on citizens. The right of freedom of speech conferred by the Constitution is also an important symbol of democracy and a civilized society. With the progress and development of society, Especially with the rapid development and popularization of the Internet, the citizen's right to freedom of speech on the Internet should also be the proper meaning of the right of freedom of speech given by the Constitution, and the right of citizens to freedom of expression on the Internet is a new civil right. Its legal regulation is also a subject with considerable space for discussion. This paper is divided into the introduction, the summary of the legal regulation of citizens' right to freedom of speech on the Internet, the present situation and problems of the legal regulation of the right to freedom of expression on the Internet of Chinese citizens, and the experience of the legal regulation of the right of freedom of expression on. The countermeasures and suggestions to improve the legal regulation of citizens' right to freedom of speech on the Internet are concluded in six chapters. The first chapter introduces the purpose and significance of the topic, as well as the related research results and viewpoints. The second chapter mainly summarizes the meaning of citizens' online freedom of speech, the meaning and value of the legal regulation of citizens' right to freedom of speech online, and the relationship between the network and the right of online citizens' right to freedom of speech. The third chapter, from the legal norm, the general administrative law norm, the technical administrative law norm, the citizen and the profession self-discipline norm several aspects has carried on the introduction to our country citizen online free speech right legislation present situation. And the above aspects of the existing problems are described and analyzed. The fourth chapter introduces the legal regulation experience of online freedom of speech in foreign countries from the aspects of relevant legislation, sound judicial relief, flexible law enforcement concept of distinguishing supervision and regulation, and self-discipline of citizens and industries. The fifth chapter, on the basis of foreign experience, according to the actual situation of our country, to improve the legal regulation of citizens' right to freedom of speech on the Internet, in the legislative, judicial, administrative law enforcement, Specific countermeasures and suggestions are put forward in the respect of citizen and industry self-discipline. Chapter six is the conclusion.
