古代保密法:漏泄罪与间谍罪

【摘要】：古人对机密泄漏带来的危险早有清醒认识。从秦汉到明清历代法律中均设有"漏泄"和"间谍"犯罪,沿革清晰。何谓秘密以及秘密如何划分等级,对是否构成泄密犯罪至关重要。古代保密主要是国家机密,不涉及对私人秘密的保护。漏泄和间谍犯罪的立法各有取义,但又密切相关。从犯罪主体上看,两类犯罪有"敌我"之分,间谍是敌人或为敌方服务之人,漏泄是我方官员,甚至皇帝信任亲近之人;从主观方面看,间谍是故意犯罪,漏泄是无心疏漏。有心漏泄以间谍罪论处;从情报传播的过程看,漏泄是源头犯罪,没有漏泄,间谍便不能得手,古代为了保密,便从源头抓起,让间谍无从下手。
[Abstract]:The ancients were soberly aware of the dangers posed by the disclosure of secrets. From the Qin and Han dynasties to the Ming and Qing dynasties, there were crimes of "leakage" and "espionage". The history was clear. What was the secret and how to classify it? Ancient secrecy is mainly a state secret and does not involve the protection of private secrets. Leakage and espionage legislation have their own meanings, but they are closely related. From the perspective of the subject of the crime, There are two types of crimes: the enemy or the enemy, the spy is the enemy or the person who serves the enemy, the leak is our officials, and even the emperor trusts the close person. In subjective terms, the spy is a deliberate crime. Leakage is an inadvertent omission. Intentional leakage is condemned as espionage. From the process of information dissemination, leakage is the source of crime. Without leakage, spies could not get it. In ancient times, in order to keep secrets, they started from the source and let spies have no way to start.
