法律社会影响评估的理论范畴及其指标体系

【摘要】：法律社会影响评估是社会影响评价技术在法律领域的应用和拓展,是对立法的社会影响后果进行预测及评价,以保证法律制定的科学性。我国法律的社会影响评估目前尚处于起步阶段,无论在理论和实践层面都缺乏必要的深入研究。法律社会影响评估以评估指标体系为核心范畴,由社会就业影响指标、公共服务影响指标、社会价值影响指标等构成。其评估指标体系的整体测度主要涵盖指标权重设置、定量与货币化分析以及信度和效度审查等内容。借助评估指标体系,可以进一步提升评估的可操作性、实现评估结果的准确与量化,从而彰显其实践价值。
[Abstract]:The social impact assessment of law is the application and expansion of the technology of social impact assessment in the field of law, and it is the prediction and evaluation of the social impact of legislation. In order to ensure the scientific nature of law making, the social impact assessment of law in our country is still in its infancy at present, and it lacks the necessary in-depth research both in theory and in practice. The core category of social impact assessment of law is the evaluation index system. It consists of social employment impact index, public service impact index, social value impact index and so on. The whole measure of its evaluation index system mainly covers the setting of index weight. Quantitative and monetization analysis, reliability and validity examination and so on. With the help of evaluation index system, the maneuverability of evaluation can be further enhanced, the accuracy and quantification of evaluation results can be realized, and its practical value can be demonstrated.
