武则天时期惩治官吏腐败制度探析

【摘要】：官吏腐败犯罪的预防和惩治是历代统治者十分重视的问题。唐代进入封建社会法制的成熟阶段,在借鉴前代惩治腐败经验的基础上,丰富并完善了相关制度体系。处在唐代初期的武则天,在惩治官吏腐败制度方面有许多创举,这些举措对其执政期间的反腐惩贪工作发挥了一定的积极作用。本文分为五个部分对武则天时期惩治官吏腐败的制度进行介绍。第一部分从武则天时期的政治状况入手,探究当时的阶级变革、政局动荡以及边境不宁的情况,为下文对具体制度的探讨作铺垫。第二部分从官吏管理制度、监察制度以及刑罚制度三个方面对武则天时期的具体运行情况进行讨论。官吏管理制度又分为选官制度、任官制度和考课制度,分析武则天采取这些制度对预防官吏腐败的作用。第三部分将监察制度分为御史制度和谏官制度进行阐述。御史制度方面,武则天设置左右肃政台;谏官制度方面,则增设补阙、拾遗等谏官。第四部分《唐律疏议》将官吏腐败的表现分为贪污、行贿受贿、勒索财物、徇私舞弊以及其他规定。在此基础上,讨论武则天时期惩处官吏腐败的实践,举例分析说明武则天在惩处官吏腐败方面态度坚决,方法有效。第五部分对武则天时期的各项制度进行评价,阐述它们在惩治官吏腐败中的积极作用和消极影响,并为当今的反腐工作提供借鉴。
[Abstract]:The prevention and punishment of official corruption crime is a problem that rulers of all dynasties attach great importance to.The Tang Dynasty entered the mature stage of feudal society legal system, which enriched and perfected the relevant system system on the basis of the experience of punishing corruption in the previous generation.Wu Zetian, who was in the early Tang Dynasty, had many innovations in punishing official corruption system, which played a positive role in anti-corruption and corruption punishment during his administration.This article is divided into five parts to introduce the system of punishing official corruption in Wu Zetian period.The first part starts with the political situation of Wu Zetian period, and probes into the class change, the political instability and the restless border situation at that time, which paves the way for the discussion of the concrete system below.The second part discusses the operation of Wu Zetian from three aspects: official management system, supervision system and penalty system.The management system of officials is divided into the system of selecting officials, the system of official appointment and the system of examination, and the function of Wu Zetian to prevent corruption of officials is analyzed.The third part divides the supervision system into the imperial history system and the admonition official system.In the aspect of imperial history system, Wu Zetian set up the right and left political platform, and the remonstrating official system added the supplementary que, picked up the remonstrant officials and so on.In the fourth part, official corruption is divided into corruption, bribery, extortion, favoritism and other provisions.On this basis, this paper discusses the practice of punishing official corruption in Wu Zetian's period, and gives an example to illustrate the firm attitude and effective methods of Wu Zetian in punishing official corruption.The fifth part evaluates every system of Wu Zetian period, expounds their positive role and negative influence in punishing official corruption, and provides reference for anti-corruption work today.
