法律硕士复合型人才结构要素的实证分析

【摘要】：法律硕士复合型人才的结构要素包括知识结构’、能力结构和素质结构。复合型法律硕士应具备坚实和系统的法学基础理论素养,掌握宽广的法律实务知识,具有宽口径、复合型、外向型的知识结构、能力结构和素质结构。《法律硕士专业学位研究生指导性培养方案》及其修订和说明,在培养目标和培养方式中对法律硕士学生的知识、能力和素质结构作出了明确规定,特别是对法律职业能力作了系统说明。但是在教育实践中多数培养单位并未引起足够的重视,甚至存在实践教学虚化,培养方式和法学硕士雷同化的严重倾向,法律硕士研究生知识、能力和素质结构不合理、不协调,完全背离了专业硕士教育的目标。判定某一个专业人才知识、能力、素质的结构是否合理的标准主要有两个：一是法律硕士专业人才和实践的契合度；二是与国家培养方案的相对一致程度和创新程度。为了适应研究生教育转型发展战略的要求,弄清复合型法律硕士人才的知识、能力和素质结构的现状,进而分析法律硕士教育中存在的突出问题及深层次原因,探索复合型法律硕士人才培养的特殊性,全面创新法律硕士教育的理念和模式,为今后制定相关政策提供可参考的范例,特展开本次调查研究。我们采用调查问卷的方式,在对复合型法律硕士的知识结构、能力结构和素质结构进行系统调研的基础上,进一步分析其原因,从而提出改善与提高复合型法律硕士知识、能力与素质结构的基本对策。文章共分为四部分,第一部分介绍调查的基本情况,第二部分介绍我国复合型法律硕士的现状,第三部分进一步分析现状的原因,第四部分最后提出解决现状的对策。
[Abstract]:The structural elements of compound talents of master of law include knowledge structure, ability structure and quality structure.The master of law of compound type should have solid and systematic knowledge of basic theory of law, master broad knowledge of law practice, have wide caliber, compound, extroverted knowledge structure,Ability structure and quality structure. The "guiding training Program for Postgraduate students of Master of Law degree" and its revision and explanation have clearly stipulated the knowledge, ability and quality structure of law master students in their training objectives and ways.In particular, the legal professional ability to make a systematic explanation.However, most of the training units have not paid enough attention to it in the educational practice, even have the serious tendency of practice teaching vacuity, the training way and the law master's degree being identical, and the structure of knowledge, ability and quality of the law master graduate students is unreasonable.Disharmony completely deviates from the goal of professional master's education.There are two standards to judge whether the structure of a certain professional talent's knowledge, ability and quality is reasonable: one is the degree of conformity between the master of law and the practice, the other is the degree of relative consistency and innovation with the national training program.In order to meet the requirements of the transformation and development strategy of graduate education, to make clear the current situation of the knowledge, ability and quality structure of the compound master of law, and then to analyze the outstanding problems and deep reasons in the education of master of law.This paper explores the particularity of the cultivation of compound master of law talents, innovates the concept and mode of master of law education in an all-round way, and provides an example for reference in formulating relevant policies in the future.On the basis of the systematic investigation of the knowledge structure, ability structure and quality structure of the compound master of law, we adopt the method of questionnaire.The reasons are analyzed in one step, and the basic countermeasures to improve and enhance the knowledge, ability and quality structure of the compound master of law are put forward.The article is divided into four parts: the first part introduces the basic situation of the investigation, the second part introduces the current situation of the compound master of law in our country, the third part further analyzes the reasons of the present situation, and the fourth part puts forward the countermeasures to solve the present situation.
