中国传统“家”的法哲学表达与演变

【摘要】:与西方法理秩序中的“无家性”相反,传统中国人以缜密的家内秩序观与完备的家国儒学体系构建起其对“家”的认知图景:作为法哲学基本范式的礼法关系,呈现出“泛家性”的特征,这一特征成为支撑中国传统社会“家者国之则”秩序体系的前提。“家”作为规范性秩序的源发地,不仅是成就身位的场所,更是维系国法的前提。中国传统国家与乡土共同体之间互动关系的演变表明,“礼法”是家内法哲学的根基,家内秩序是政治世界构造的同质性延伸,“家本位”通过“移孝于忠、礼法共存”的介质来规范“家-国”关系中的基本要素。由“家”的法哲学秩序所传递的“先家”“重家”观念,既是理解中国传统礼法关系的切入点,更是重建当代基层伦理的一个重要思想资源。
[Abstract]:Contrary to the "homelessness" in the western legal order, the traditional Chinese constructed their cognitive picture of "home" with a careful view of the internal order and the complete system of family Confucianism: the relationship between etiquette and law as the basic paradigm of the philosophy of law.It presents the characteristic of "pan-family", which becomes the premise of supporting the "rule of family" system in traditional Chinese society.As the source of normative order, "home" is not only the place of achievement, but also the premise of maintaining national law.The evolution of the interactive relationship between the Chinese traditional state and the local community shows that "ritual law" is the foundation of the philosophy of family law, and the family order is the homogenous extension of the structure of the political world, and the "family standard" transfers filial piety to loyalty through "shifting filial piety".The medium of the coexistence of etiquette and law regulates the basic elements of the relationship between home and country.The concept of "first home" and "emphasizing family" transmitted by the legal philosophy order of "home" is not only the starting point of understanding the traditional Chinese propriety and law relationship, but also an important ideological resource for rebuilding the contemporary grass-roots ethics.
