论韩国海洋警察厅的主要职能

【摘要】：韩国海洋警察厅是维护韩国海上治安、实施海难搜救、保护海洋环境的海上警务力量,其机构完善、设备先进,反应十分迅速、措施较为强硬,职能具有很强的综合性,在维护韩国海洋权益的过程中发挥着十分重要的作用。大量的韩国海洋法规、国际公约和国际习惯是韩国海洋警察厅的执法依据。韩国海洋警察厅共享的韩国综合行政信息系统,为海洋警察厅的执法和管理带来了极大的便利。为了营造绿色的海洋环境,应对海上管理的新变化,韩国海洋警察厅制定了五大目标职能:保护完整的海洋主权、确保国民信赖的海上治安、构筑东北亚HUB—PORT化的海上安全基础、保护海洋环境以及提高海警服务。韩国海洋警察厅的目标虽然比较完善,但基于韩国的技术、综合国力以及韩国海洋警察厅的机构设置等多方面的原因,其目标始终没能够得以完全实现。目前韩国海洋警察厅主要有以下几个方面的现实职能:海上搜索救援,海上船舶的安全管理,民用海事行为管理,保障专属经济区的海洋主权,推进港湾管制所、海水部、海警协同作业进程,海洋环境执法以及及时有效的海难救助。由于韩国海洋警察厅的目标职能与现实职能之间的差距,韩国海洋警察厅亟待进行职能扩展。但是,韩国海洋警察厅如要进行职能扩展则面临着诸多问题,如人员危机、海洋安保环境的复杂化以及职能与机构设置的衔接障碍等。目前,韩国海洋警察厅出台了几项职能扩展规划,其中包括:制定BSC(成果管理)制度;修改并完善水上行驶器具安全法;防治海洋污染以及防止偷渡及间谍渗透等。韩国海洋警察厅在其法律机制构建和海洋执法力度上已经展现出它的先进性,其发展经验值得借鉴。中国作为海洋大国应当建立以警察权为核心的海洋综合管理体制、完善海洋管理法律法规体系、统一我国海上联合执法队伍并加强我国海洋警备建设,才能真正对我国广阔海域进行有效管理。
[Abstract]:The Korea Marine Police Agency (KMPA) is a maritime police force that maintains maritime security in Korea, carries out maritime rescue and rescue operations, and protects the marine environment. Its organization is perfect, its equipment is advanced, its response is very rapid, its measures are relatively tough, and its functions are very comprehensive.It plays a very important role in the process of safeguarding Korea's maritime rights and interests.A large number of Korean maritime laws and regulations, international conventions and international customs are the law enforcement basis of the Korea Marine Police Agency.The Korea Integrated Administrative Information system shared by the Korea Marine Police Agency has brought great convenience to the enforcement and management of the Marine Police Agency.In order to create a green marine environment and cope with the new changes in maritime management, the Korea Marine Police Agency has formulated five major objective functions: to protect the integrity of maritime sovereignty and to ensure the trust of citizens in maritime security.To construct the maritime security foundation of HUB-PORT in Northeast Asia, to protect the marine environment and to improve the marine police service.Although the goal of Korea Marine Police Agency is relatively perfect, its goal has never been fully realized because of its technology, comprehensive national strength and the institutional setting of the South Korean Marine Police Agency.At present, the Korea Marine Police Agency has the following practical functions: maritime search and rescue, safety management of maritime vessels, civil maritime conduct management, protection of maritime sovereignty in the exclusive economic zone, promotion of the Harbour Control Institute, and the Ministry of seawater.Marine Police cooperate in the process of operation, marine environmental law enforcement and timely and effective rescue at sea.Because of the gap between the target function and the actual function of the Korea Marine Police Agency, it is urgent for the Korea Marine Police Agency to expand its functions.However, if the South Korea Marine Police Agency wants to expand its functions, it faces many problems, such as personnel crisis, the complexity of marine security environment and the obstacles of linking functions and institutions.At present, the Korea Marine Police Agency has issued several functional expansion plans, including: formulating the BSC-Results-based Management system; revising and perfecting the Safety Law for driving utensils on Water; preventing Marine pollution and preventing smuggling and espionage infiltration, and so on.South Korea Marine Police Agency has shown its advanced nature in its legal mechanism construction and maritime law enforcement, and its development experience is worthy of reference.As a major maritime power, China should establish a comprehensive marine management system with police power as the core, perfect the maritime management laws and regulations system, unify our maritime joint law enforcement team, and strengthen the building of marine police in our country.In order to truly carry on the effective management to our country's vast sea area.
