陕甘宁边区司法制度的“语境论”分析——以马锡五审判方式为例

【摘要】：陕甘宁边区的司法制度作为新中国司法的制度性法源,一直为学界所关注,但对其历史地位和现实意义,却呈现出两极化的评价。本文运用"语境论"的法律制度研究方法,以边区司法制度的典型——马锡五审判方式为例进行多维度分析,强调要历史地辩证地看待马锡五审判方式的地位和作用。如此,才能对马锡五审判方式及其代表的边区司法制度的历史地位作出符合"当时语境"、客观公正的认识和评价。
[Abstract]:The judicial system of the Shensi-Kansu-Ningsia Border region, as the institutional source of justice in New China, has always been concerned by the academic circles, but its historical status and practical significance show a polarized evaluation.In this paper, the author uses the research method of legal system of "context theory", taking the typical judicial system of the border region-Ma Xi-wu as an example to carry on the multi-dimensional analysis, and emphasizes that the position and function of Ma Xi-wu 's trial mode should be viewed dialectically in history.Only in this way can we make an objective and fair understanding and evaluation of the judicial system of Ma Xi-wu and its representative judicial system in accordance with the "context at that time".
