论法治中国建设指标体系和考核标准的构建

【摘要】：法治评估将数据量化技术引入到法治考核领域,是社会治理领域的一次重大方法论创新。中共十八届三中全会提出要"建立科学的法治建设指标体系",这是法治建设评估第一次出现在最高的中央文件中。虽然法治建设评估在国内几个区域内已进行了不同的实践,但是无论从指标程序设计还是区域内实施,都存在不同程度的缺陷。法治中国的评估考核,首先应从理解"法治中国"的内涵入手,根据法治中国建设的要求,制定全面可执行的法治建设评估考核体系,法治中国建设评估的关键点在于如何设定可量化评估的指标,运用统计量化技术得出科学的量化结论,以评估促考核,以考核促法治发展。法治中国建设评估与考核终将成为法治中国建设有力的助推器。本文的研究立足于中国法治发展的特色和发展的现状,以探究建立一个全面、系统、科学、可执行的法治中国建设指标体系和考核标准为目标,从法治中国建设的内涵要义入手,阐述法治中国评估考核的现实意义及应坚持的基本定位;第二部分论述从法治指标的一般特征和类型,到一个完整的法治中国建设指标体系的设计,设计了法治中国建设的八个维度,分三级指标,层层递进;第三部分是指标体系的科学量化方法的设计,包括原始数据的标准化处理过程、权重赋值的方法和指标体系运算规则的选取,本部分以目前国内存在的几大区域法治评估量化方法为例,指出其法治评估设计与实施的可借鉴经验和应注意的问题;最后一部分紧扣考核主题,包括考核标准的设计和考核程序的实施两部分,明晰法治中国建设评估的功用。
[Abstract]:It is an important methodological innovation in the field of social governance to introduce the data quantification technology into the field of rule of law assessment.The third Plenary session of the 18th CPC Central Committee proposed "establishing a scientific index system for the construction of the rule of law", which is the first time that the evaluation of the construction of the rule of law appears in the highest central document.Although the evaluation of the construction of rule of law has been carried out in different practice in several regions of our country, there are some defects in the index program design and the implementation in the region.The evaluation and assessment of China under the rule of law should begin with the understanding of the connotation of "China under the rule of law" and establish a comprehensive and enforceable evaluation and assessment system for the construction of China under the rule of law according to the requirements of the construction of China under the rule of law.The key point of the evaluation of China's construction under the rule of law lies in how to set the quantifiable evaluation index and draw the scientific quantitative conclusion by using the statistical quantification technique, so as to evaluate and promote the development of the rule of law.The evaluation and assessment of the construction of China ruled by law will eventually become a powerful booster for the construction of China ruled by law.Based on the characteristics of the development of China's rule of law and the present situation of its development, this paper aims at exploring the establishment of a comprehensive, systematic, scientific and enforceable index system and assessment standards for the construction of China under the rule of law.Starting with the connotation of the construction of China under the rule of law, this paper expounds the realistic significance and the basic orientation of the evaluation and assessment of the rule of law in China. The second part discusses the general characteristics and types of the index of rule of law.To the design of a complete index system for the construction of China under the rule of law, eight dimensions of the construction of China under the rule of law have been designed, which can be divided into three levels of indicators, and the third part is the design of the scientific quantitative method of the index system.It includes the standardization process of raw data, the method of weight assignment and the selection of operational rules of index system. This part takes the quantitative method of evaluating the rule of law in several large regions in our country as an example.The author points out that the design and implementation of the rule of law evaluation can draw lessons from the experience and problems that should be paid attention to, and the last part is closely related to the subject of examination, including the design of the assessment standard and the implementation of the assessment procedure, so as to clarify the function of the evaluation of the construction of the rule of law in China.
