立法后评估结果回应机制研究

【摘要】：作为社会主义法治国家建设进程的重要环节,立法后评估对于提高立法质量,改进立法工作具有特殊的意义和价值。立法后评估结果是立法后评估主体对法律实施效果进行评价后所形成的评估报告,目的在于针对法律法规自身的缺陷能够及时加以修改和完善,即通过“立法回头看”的方式对法律法规进行完善。实践表明,要真正使立法后评估制度发挥实效,实现法律法规的与时俱进,应当保障立法后评估结果得到国家立法机关的有效回应,构建起完善的立法后评估结果的回应机制。立法后评估结果的回应机制,是指特定国家机关按照法定程序机制,对立法后评估报告中指出的立法质量和法律法规实施等方面的问题,采取特定方式作出回复或反应,以实现立法后评估制度的预期目的。文章通过对立法后评估回应进行规范分析和实践考察,从立法层面的完善、主体能力的加强和配套制度的建构三个方面入手提出了构想,认为完善立法后评估回应机制的关键在于构建起有效支撑立法后评估回应的立法体制,从顶层设计的角度重塑立法后评估回应的组织机构和运作机制,实现立法后评估结果回应制度的统一化、规范化和制度化。从规范层面而言,由《立法法》对立法后评估回应内容进行宏观规定有助于规范化的立法后评估回应机制的有序运作。同时,各地关于立法后评估制度的规范性文件应当对回应机制的具体操作进行细化,对立法后评估回应的主体、程序、方式等进行明确规定,使立法后评估制度更具有针对性、可操作性和有效性。此外,还要加强立法后评估回应主体能力建设及健全相关配套制度。唯有如此,完善立法质量的最终目的才能得以实现,立法后评估制度才真正发挥了其应有功能。
[Abstract]:As an important link in the process of building a socialist country ruled by law, post-legislative evaluation has special significance and value for improving the quality of legislation and improving the work of legislation.The result of post-legislative evaluation is an evaluation report formed by the subject of post-legislative evaluation of the effect of law implementation. The purpose of the report is to modify and perfect the laws and regulations in time in view of their own shortcomings.That is, through the "legislation look back" way to improve the laws and regulations.Practice shows that in order to make the system of post-legislative evaluation effective and realize the laws and regulations to keep pace with the times, we should ensure that the results of post-legislative evaluation get an effective response from the national legislative organs, and construct a perfect response mechanism of the post-legislative evaluation results.The response mechanism of the results of the post-legislative evaluation refers to the specific state organs responding or responding to the problems concerning the quality of the legislation and the implementation of laws and regulations, as pointed out in the report on the post-legislative assessment, in accordance with the mechanism of legal procedures.In order to achieve the purpose of the post-legislative evaluation system.Through the normative analysis and practice investigation of the post-legislative evaluation response, this paper puts forward the conception from three aspects: the perfection of legislation, the strengthening of the subject's ability and the construction of supporting system.The key to perfect the post-legislative evaluation response mechanism is to construct a legislative system to support the post-legislative evaluation response effectively, and to reshape the organization and operation mechanism of the post-legislative evaluation response from the perspective of top-level design.To realize the unification, standardization and institutionalization of the response system of the evaluation results after legislation.From the normative level, the macro-regulation of the content of post-legislative evaluation response by the Legislative Law is helpful to the orderly operation of the standardized post-legislative evaluation response mechanism.At the same time, the local normative documents on the post-legislative evaluation system should refine the concrete operation of the response mechanism, clearly stipulate the subject, procedure and manner of the post-legislative evaluation response, so as to make the post-legislative evaluation system more targeted.Maneuverability and effectiveness.In addition, we should strengthen the capacity building of the post-legislative evaluation response and improve the relevant supporting system.Only in this way, the final goal of perfecting the quality of legislation can be realized, and the system of post-legislative evaluation can really play its proper function.
