依法治国的文化解释

【摘要】：依法治国作为一种中国式的法治与文化,是从中国固有的文化传统中生长起来的。具体地说,依法治国是先秦法家的以法治国吸纳了西方传来的法治文化的产物。从文化传承的角度看,从先秦法家的以法治国到当代中国的依法治国,是一条持续不断的文化主流。从文化交往的角度看,西方法治文化是19世纪末期汇入中国文化主流的。相对于西方汇入的法治文化而言,先秦法家的以法治国构成了依法治国的文化源头。较之于西方传来的法治文化,先秦法家的以法治国更有力地塑造了当代中国的法治形态,那就是当代中国的依法治国。
[Abstract]:The rule of law, as a Chinese-style rule of law and culture, grew from the Chinese inherent cultural tradition.To be specific, the rule of law is the product of the rule of law culture from the west.From the perspective of cultural inheritance, from the rule of law of the pre-Qin legalists to the rule of law in contemporary China, it is a continuous cultural mainstream.From the angle of cultural communication, the western culture of rule of law was merged into the mainstream of Chinese culture in the late 19 th century.Compared with the western culture of rule of law, the rule of law by law constituted the cultural source of governing the country according to law.Compared with the culture of rule of law from the west, the rule of law of the pre-Qin legalists shaped the rule of law in contemporary China more forcefully, that is, the rule of law in contemporary China.
