人工智能在社会应用中的法律问题研究

【摘要】：在计算机科学、互联网、物联网和大数据等技术近年来高速发展的基础上,人工智能技术的研究和应用掀起了新的高潮,不断改变着人们传统的生活方式,利用智能技术给人们的工作、生活带来极大便利。与此同时,人工智能的社会化应用也引发了一些现实的法律问题和对未来法律体系的隐忧,现行的法律条文已很难解决这些问题,当前的成文法体系也很难适应未来人工智能技术下的社会环境。从当前现实法律问题出发,诸如自动驾驶汽车造成的车祸、手术机器人出现的医疗事故、数据挖掘对个人信息的侵犯等实际问题发生后的法律救济如何实施,是人工智能对现行法律规范提出的挑战,需要法律对其属性进行研究明确。从人工智能未来发展给法律体系带来的隐忧考虑,未来的强人工智能和超人工智能将形成社会智能的大爆炸,它的智能水平将无限接近甚至远远超越人类,社会新事物的产生速度不断加快,现在的成文法体系将因不能满足社会对法律的需求而逐渐消亡,人类需要提前采取措施应对可能面临的法律体系危机。通过研究发现,这些问题和危机是可以通过人类的前瞻性工作逐步解决和化解的,比如针对人工智能技术出台司法解释,加强行业监管,强化安全教育,研究新型法律,制定技术发展的原则性法律法规等措施,将在解决当前和未来人工智能社会应用引发的问题中发挥一定作用,从而尽可能规避危机的出现,使人工智能技术更好的服务于人类社会的不断进步。
[Abstract]:On the basis of the rapid development of computer science, the Internet of things, Internet of things and big data in recent years, the research and application of artificial intelligence technology has set off a new climax, constantly changing people's traditional way of life.The use of intelligent technology to people's work, life brings great convenience.At the same time, the socialized application of artificial intelligence has also caused some practical legal problems and hidden worries about the future legal system, and the current legal provisions are already very difficult to solve these problems.The current statutory system is also difficult to adapt to the future artificial intelligence technology under the social environment.How to implement the legal relief after the actual legal problems, such as accidents caused by self-driving cars, medical accidents caused by surgical robots, the violation of personal information by data mining, etc.Artificial intelligence is a challenge to the current legal norms, which needs to be studied clearly by law.Considering the hidden worries brought by the future development of artificial intelligence to the legal system, the strong artificial intelligence and super artificial intelligence in the future will form a big explosion of social intelligence, and its intelligence level will be infinitely close to, or even far ahead of, human beings.The emergence of new social things is speeding up, and the current statutory law system will die out gradually because it can not meet the needs of the society. Human beings need to take measures to deal with the possible legal system crisis ahead of time.Through research, it is found that these problems and crises can be gradually solved and resolved through the forward-looking work of human beings, such as the introduction of judicial interpretations for artificial intelligence technology, the strengthening of industry supervision, the strengthening of safety education, and the study of new types of laws.The formulation of principled laws and regulations for technological development will play a role in solving the problems caused by the application of artificial intelligence at present and in the future, so as to avoid the emergence of the crisis as far as possible.Make artificial intelligence technology better serve the progress of human society.
