“阳某等与胡某宅基地房屋买卖合同纠纷案”评析

【摘要】:随着农村居民身份转变为城市居民的情形增多,当转城居民在农村的合法宅基地房屋遭遇拆迁问题时,出现了很多权利被侵害的情况,同时也出现了由于宅基地房屋拆迁而导致的各种矛盾激化问题,转城居民的农村宅基地房屋拆迁的相关权利如何保障的问题值得研究。 原告阳某及其子女张某等是转城居民,原告与被告之间签订了《房屋买卖协议》,买受人在房屋面临拆迁时,在合同约定其不享有土地处置权利的情况下拆除了房屋,村委会则以房屋灭失为由收回了房屋范围内的集体土地使用权,,原告请求法院确认《房屋买卖协议》无效而发生纠纷。法院最终判决该《房屋买卖协议》有效,并驳回了原告返还房屋所有权的诉讼请求。该案的特殊性就表现在转城居民继承的农村集体土地上的房屋面临拆迁时,是否享有拆迁权利的问题以及该案的原告的权利是否被侵权。但在该案件处理过程中,代理律师如果使用不同的诉讼策略得到的救济结果不同,原审律师采用了合同之诉并没有达到维护原告利益的效果,如果采用侵权之诉则能够更好的达到保护作为转城居民的原告利益的目的。通过对这些问题的分析同时结合目前农村房屋土地案件处理的现况及发展趋势,可以寻求类似问题更好的解决方法。在我国目前的法律环境下,转城居民的宅基地房屋没有很好的退出机制,国家法律应当保障集体土地房屋拆迁过程中作为转城居民拆迁户的利益不受非法侵犯。因此,国家应当尽快制定农村房屋拆迁管理条例,解决广大的农村集体土地房屋拆迁日益突出并不断激化的社会矛盾和问题。
[Abstract]:As the status of rural residents has changed into urban residents, when the legal homestead houses in rural areas are being demolished, many rights have been infringed upon.At the same time, there are various contradictions caused by the demolition of homestead houses, and it is worth studying how to protect the rights of the rural homestead house demolition of urban residents.The plaintiff, Yang Mou and his child, Zhang, were residents of the city. The plaintiff and the defendant signed a "house sale agreement". When the house was facing demolition, the buyer demolished the house when the contract stipulated that he did not have the right to dispose of the land.The village committee took back the collective land use right on the grounds of house loss, and the plaintiff asked the court to confirm that the house sale agreement was invalid.The court finally ruled that the agreement was valid and rejected the plaintiff's claim to return home ownership.The particularity of this case is that when the houses on the rural collective land inherited by the residents of the city are faced with demolition, whether they enjoy the right of demolition and whether the rights of the plaintiffs in this case are infringed.However, in the course of handling the case, if the lawyer used different litigation strategies to obtain different relief results, the original trial lawyer adopted the contract action and did not achieve the effect of safeguarding the interests of the plaintiff.If the tort action is adopted, it can better protect the interests of the plaintiff.Based on the analysis of these problems and the current situation and development trend of rural housing land cases, we can find a better solution to similar problems.In the current legal environment of our country, there is no good exit mechanism for the house and house of the residents of the city, and the national law should protect the interests of the residents who are the residents of the city from being infringed illegally in the process of the demolition of the collective land houses.Therefore, the country should formulate the regulations of the rural house demolition management as soon as possible to solve the social contradictions and problems which are increasingly prominent and intensified in the rural collective land house demolition.
