论三国魏文帝时期“怨毒杀人减死”的刑法精神

【摘要】：三国魏文帝时期颁布的"怨毒杀人减死"法令,沈家本先生的《历代刑法考》从该法令的起源"刘朱案"讲起,分析了"怨毒杀人"的基本概念以及对遭受苦毒者杀死施加苦毒者的情况。"怨毒杀人减死之令",可谓是中国古代法律的一大创举,体现了三国魏时期立法者对于刑法的谦抑、罪刑相适应原则的初步探究,"怨毒杀人减死"本身体现的刑法精神对我国现行法制具有一定的借鉴意义。
[Abstract]:From the origin of the "Liu Zhu case", Mr. Shen Jiaben's "A textual Research on the Criminal Law of the past dynasties" issued a decree of "resentful poison, killing and reducing death" in the period of Wei Wendi of the three Kingdoms.This paper analyzes the basic concept of "venomous murder" and the situation of killing those who suffer from bitter poison. "It can be said that the order to reduce death by killing drugs "is a great innovation in ancient Chinese law, which reflects the modesty of legislators' restraint on the criminal law during the period of the three Kingdoms of the Wei Dynasty.The preliminary research on the principle of adaptation of crime and punishment shows that the spirit of criminal law embodied in "resentful drug killing and reducing death" has certain reference significance to the current legal system of our country.
