欧洲的“天空开放”:航权交换区域合作模式的新发展

【摘要】：航权是国家主权在民航运输领域的具体表现,航权交换是国际民航运输活动最基本的法律手段。传统芝加哥体系要求航权交换由政府间依双边方式进行,随着国际实践的不断发展,航权交换活动呈现出区域合作的模式,其中欧洲最具代表性。欧洲航权交换区域合作模式的成功之处在于其区域融合和一体化的良好基础,有效的民航协调机制以及渐进性、阶段化的举措。这种航权交换区域合作模式有力促进了包括亚洲在内的航空自由化的发展。2007年欧盟与美国达成的"天空开放"协定缔造了全球最大的航空市场——北大西洋"天空开放"区域,将航权交换的区域合作推向顶峰,具有深远意义。航权交换区域合作模式不仅有利于克服不同航空利益间的冲突,带来规则融合的可行性,还导致了"联合空域"的出现,其在推动航权交换法律体制发展中的潜力非常值得关注。
[Abstract]:Freedom right is the concrete manifestation of national sovereignty in the field of civil aviation transportation, and the exchange of air rights is the most basic legal means of international civil aviation transport activities.The traditional Chicago system requires the exchange of air rights between governments to be carried out by bilateral means. With the continuous development of international practice, the exchange of air rights presents a pattern of regional cooperation, among which Europe is the most representative.The success of the regional cooperation model of European air rights exchange lies in the good foundation of regional integration and integration, the effective civil aviation coordination mechanism and the gradual and phased measures.This model of regional cooperation in the exchange of air rights has contributed to the development of aviation liberalization, including in Asia. The "open skies" agreement reached in 2007 between the European Union and the United States created the largest aviation market in the world, the North Atlantic "Sky Open" region,It is of great significance to push the regional cooperation in the exchange of air rights to the top.The regional cooperation model of air rights exchange not only helps to overcome the conflicts between different aviation interests, but also leads to the emergence of "joint airspace".Its potential in promoting the legal system of air rights exchange is worthy of attention.
