法治社会建设的“中国特色”研究

【摘要】：建设中国特色社会主义法治社会,是全面推进依法治国的重要组成部分。“中国特色”之于法治社会建设是怎样的呈现方式和基本的评估要求呢?对此,学界的一些成果虽然有“中国特色”之冠名,但是在内容上对于“中国特色”这一概念的学理内涵及其在法治社会建设中如何认识和把握等问题,都没有作出较好的研判。因此,研究法治社会建设的“中国特色”,探寻“中国特色”的科学本义及其在法治社会建设上的基本要求和具体表达,对于匡正社会上之于“中国特色”的各种误解,在法治社会建设过程中科学把握“中国特色”的根本尺度,提升社会主义法治思想教育的实效性,是有着实际的理论意义和现实意义的。研究法治社会建设的“中国特色”问题,本着唯物史观的思想方法为指导,依循法治社会建设的理论和实践基本方面,综合运用文献分析法、历史溯源法和比较研究法,以发达国家作为法治社会建设的比较对象,对“中国特色”在法治社会建设的基本要求和具体表达进行了系统分析和基本理论概括。全文由绪论、正文、结语等部分构成,正文部分共三章。第一章概括了“中国特色”的基本内涵。“中国特色”是在坚持社会主义基本原则的前提下,从中国的实际出发,体现中华民族优秀品质并吸收借鉴人类发展文明成果的,对中国独有的能够创造性地解决中国问题的理论和实践的概括。第二章是对法治社会建设理论的比较思考。坚持中国特色社会主义法律制度、秉承中国特色社会主义法治理论,是法治社会建设性质上的中国特色;构建和谐社会是法治社会建设目标上的中国特色;坚持党的领导、坚持人民主体地位是是法治社会建设原则上的中国特色。第三章对法治社会建设实践进行对比研究。依靠组织领导有序地推动是法治社会建设路径上的中国特色;汲取中华优秀传统文化、中华法律文化和红色文化的精髓,将其与现代法治文化相结合进行法治意识培养,是法治社会建设方式的中国特色;贯彻群众路线、实行人民调解、提供公共法律服务、强化基础性制度建设是法治社会建设举措上的中国特色。结语部分对论文做出总结概括。维护人民根本利益是法治社会建设的一贯价值追求,法治社会建设方面所展现的人民至上的“中国特色”这一本质深化了“中国特色”的内涵。
[Abstract]:Building a socialist society ruled by law with Chinese characteristics is an important part of comprehensively promoting the rule of law. What are the presentation methods and basic evaluation requirements of "Chinese characteristics" in the construction of a society ruled by law? In view of this, although some academic achievements have the name of "Chinese characteristics", but the content of the concept of "Chinese characteristics", and how to understand and grasp the concept of "Chinese characteristics" in the construction of a society under the rule of law and so on. Have not made a better study of the judgment. Therefore, to study the "Chinese characteristics" of the construction of a society ruled by law, to explore the scientific meaning of "Chinese characteristics" and its basic requirements and concrete expressions in the construction of a society ruled by law, to correct all kinds of misunderstandings in the society of "Chinese characteristics". It is of practical theoretical and practical significance to scientifically grasp the basic measure of "Chinese characteristics" in the process of building a society ruled by law and to improve the effectiveness of socialist ideological education on the rule of law. To study the problem of "Chinese characteristics" in the construction of a society ruled by law, guided by the thought and method of historical materialism, and in accordance with the basic aspects of theory and practice in the construction of a society ruled by law, comprehensive use of literature analysis, historical traceability and comparative research, Taking the developed countries as the comparative object of the construction of a society ruled by law, this paper makes a systematic analysis and theoretical summary of the basic requirements and concrete expressions of "Chinese characteristics" in the construction of a society governed by law. The full text is composed of introduction, text, conclusion and so on. The first chapter summarizes the basic connotation of "Chinese characteristics". On the premise of adhering to the basic principles of socialism, "Chinese characteristics" reflect the excellent qualities of the Chinese nation and draw lessons from the achievements of human civilization development from the point of view of China's reality. A summary of China's unique theory and practice of creative solutions to China's problems. The second chapter is the comparative thinking of the construction theory of the rule of law society. Adhering to the socialist legal system with Chinese characteristics and adhering to the theory of socialist rule of law with Chinese characteristics is the Chinese characteristic in the nature of the construction of a society ruled by law; building a harmonious society is the Chinese characteristic of the goal of building a society ruled by law; and adhering to the leadership of the Party, Adhering to the status of the people as the main body is the Chinese characteristic in the principle of the construction of a society ruled by law. The third chapter makes a comparative study on the practice of building a society ruled by law. Relying on the leadership of the organization to promote orderly is the Chinese characteristics in the path of the construction of a society ruled by law, drawing on the essence of Chinese excellent traditional culture, Chinese legal culture and red culture, and combining it with the modern culture of rule of law to cultivate the consciousness of the rule of law. The conclusion part summarizes the thesis. Safeguarding the fundamental interests of the people is the consistent value pursuit of the construction of a society ruled by law, and the essence of the people's supreme "Chinese characteristics" in the construction of a society ruled by law deepens the connotation of "Chinese characteristics".
