论法德结合的社会治理价值导向

【摘要】：全面推进国家治理体系现代化,提高社会治理能力和治理水平,既要靠良法,又要靠善治。法德结合的社会治理价值导向,是良法和善治的结合,能够强化公民参与共建的责任,注重日常管理中的知行合一,倡导和鼓励符合法德的行为,制约和惩处违背法德的行为。社会治理的主体和客体都是人。人所构成的社会治理网络看起来十分复杂,实际上,只要抓住法德结合这个社会治理的价值导向予以强化,就可以保证社会治理的井然有序进行。法德结合的社会治理价值导向要求公民对法律和道德高度认知,形成健全的法治心态和健全的德治心态,体现法德结合的公民精神、法德结合的叠加效应、法德配合合宜。其目标就是要在全社会形成法德信仰,法德相结合的一体化实践,以法治体现道德规范,以道德规范体现法治精神,强化法律对道德建设的促进作用,道德建设对法律的促进作用。
[Abstract]:To promote the modernization of national governance system and improve the ability and level of social governance, we must rely on good law and good governance. The value guidance of social governance of the combination of law and virtue is the combination of good law and good governance, which can strengthen the responsibility of citizens to participate in the co-construction, pay attention to the unity of knowledge and action in daily management, advocate and encourage the behavior in accordance with the law and morality, and restrict and punish the behavior of violating the law and morality. The subject and object of social governance are both human beings. The social governance network formed by human beings seems very complex. In fact, as long as we grasp the value orientation of the combination of France and Germany to strengthen the social governance, we can ensure that the social governance is carried out in an orderly manner. The value guidance of social governance of the combination of France and Germany requires citizens to have a high degree of cognition of law and morality, to form a sound mentality of rule by law and a state of mind of rule by virtue, to embody the spirit of citizenship of the combination of law and Germany, to combine the superposition effect of the combination of law and Germany, and to make the cooperation between France and Germany appropriate. Its goal is to form the belief of law and morality in the whole society, to combine the law and morality, to embody the moral standard by the rule of law, to embody the spirit of the rule of law by the moral standard, and to strengthen the role of the law in promoting the moral construction.
