论我国民主立法中的问题及完善

【摘要】：民主立法是指有民主政治权利的公民个人或群体依据法律，通过合理途径，参与立法活动的过程。当今社会，民主立法已成为世界潮流所趋。在立法中发扬民主，走群众路线，鼓励公众参与立法，在新中国成立之初就已经存在了，但是在发展过程中也存在不少问题。本论文旨在把握这一时代潮流，对民主立法的现状及未来的发展完善展开论述。整篇论文框架由导言、正文和结语组成，重点从三个方面对我国民主立法中的问题及完善展开研究。首先，论文从立法权释义入手，对民主立法的内涵进行分析，同时结合我国民主立法形成的历程以及现阶段取得的成绩，提出发展和完善民主立法工作的意义极为重大。其次，论文重点分析了我国民主立法中存在的问题，，把侧重点放在我国民主立法中出现的不足，同时借鉴国外经验，指出完善我国民主立法的时代价值和必要性。最后，论文对如何完善民主立法提出建设性意见。这些建议不仅包括完善民主立法应当遵循的原则，还明确了应当加强的理论研究，并且重点分析了民主立法完善化所需推进的实践工作。民主的发展始终遵循着“不成熟一成熟一巩固”这样一个方向而不断前进，当然在这其中也可能会反复。十一届三中全会召开以后,我国立法工作结束了低迷状态,迎来了新的起点,完善立法被提到了重要日程上来。我国的法律是人民根本利益和共同意志的集中体现,是对人民民主的确认和保障。只有遵循民主立法的要求规范立法工作,切实推进民主立法,才能避免或减少越权立法、重复立法、秘密立法等现象,充分体现人民群众的意愿,切实维护人民的根本利益。我国的民主立法虽然有了不少实践，也取得了一定成绩，但还远未到成熟程度，依然存在许多不足。因此，我国民主立法还需要进一步向纵深发展，需要正视存在的问题，加强相关理论研究，并且推进相关实践工作走向完善。民主立法是一项长期性、系统性的工作,只有牢牢树立民主立法的观念,建立和完善民主立法的制度和程序,培育健康的法律意识文化,改革和完善现行的法律制度,同时吸收并借鉴国外先进的立法经验,才能不断推进我国民主立法,促进依法治国。
[Abstract]:Democratic legislation refers to the process in which individuals or groups of citizens with democratic political rights participate in legislative activities through reasonable means according to the law. Nowadays, democratic legislation has become the trend of the world trend. Promoting democracy, following the mass line and encouraging the public to participate in legislation have already existed since the founding of New China, but there are also many problems in the process of development. The purpose of this paper is to grasp the trend of the times and discuss the status quo and future development of democratic legislation. The whole thesis frame is composed of introduction, text and conclusion. It focuses on the problems and perfection of democratic legislation in China from three aspects. First of all, the paper starts with the interpretation of legislative power, analyzes the connotation of democratic legislation, and at the same time, combines the process of formation of democratic legislation and the achievements made at the present stage, points out that it is of great significance to develop and perfect the work of democratic legislation. Secondly, the paper analyzes the problems existing in our country's democratic legislation, puts emphasis on the deficiency of our country's democratic legislation, and points out the value and necessity of perfecting our country's democratic legislation. Finally, the paper puts forward constructive suggestions on how to perfect democratic legislation. These suggestions not only include the principles that should be followed in perfecting democratic legislation, but also clarify the theoretical research that should be strengthened, and focus on the analysis of the practical work needed to promote the perfection of democratic legislation. The development of democracy has always followed the direction of immaturity rare to consolidate, which may also be repeated. After the third Plenary session of the 11th CPC Central Committee was held, the legislative work in our country ended the downturn, ushered in a new starting point, and the improvement of the legislation was put on the important agenda. The law of our country is the concentrated embodiment of the people's fundamental interests and common will, and the confirmation and guarantee of people's democracy. Only by following the requirements of democratic legislation, standardizing the legislative work and promoting democratic legislation, can we avoid or reduce the phenomenon of ultra vires legislation, repeated legislation, secret legislation and so on, fully reflect the wishes of the people and safeguard the fundamental interests of the people. Although our country's democratic legislation has a lot of practice and has made some achievements, it is still far from mature and still has many shortcomings. Therefore, China's democratic legislation still needs to develop in depth, to face up to the existing problems, to strengthen the relevant theoretical research, and to promote the improvement of relevant practical work. Democratic legislation is a long-term and systematic work. Only by firmly establishing the concept of democratic legislation, establishing and perfecting the system and procedures of democratic legislation, cultivating a healthy culture of legal consciousness, reforming and perfecting the current legal system, At the same time, we can absorb and draw lessons from foreign advanced legislative experience to promote democratic legislation and rule the country according to law.
