清末法律教育刍议

【摘要】：戊戌变法时期,在中央未能做出改变的同时,地方上的部分学堂已经尝试将法律引入课程之中。地方政府通过派人去日本考察以及大胆的实践,在促进法律教育兴起上扮演了更重要的角色。中央政府通过借鉴日本学制与吸收地方政府办理法律教育的经验制定了壬寅学制和癸卯学制。但是为了能够控制局势,中央限制了法律教育的普及。清末修律、预备立宪使得地方需要大量的法律人才,这才迫使中央政府不断调整癸卯学制中对于法律教育的限制。而正是在这个调整过程中,法律教育的兴起才真正得到实现。纵观整个过程,地方政府更具活力,不断推动中央政府实施变革。
[Abstract]:During the Reform Movement of 1898, while the central government failed to change, some local schools tried to introduce the law into the curriculum. Local governments have played a more important role in promoting the rise of legal education by sending people to Japan to investigate and practice boldly. By drawing lessons from Japanese school system and absorbing the local government's experience in legal education, the central government has formulated the nonyin school system and the Guimao school system. But in order to control the situation, the central government restricted the popularization of legal education. At the end of Qing Dynasty, the preparation of constitutionalism required a large number of legal talents, which forced the central government to constantly adjust the restrictions on legal education in Guimao school system. It is in the process of adjustment that the rise of legal education is truly realized. Throughout the whole process, local governments are more dynamic, constantly pushing the central government to implement change.
