【摘要】：地方行政立法是我国立法体制的重要组成部分,公众参与地方行政立法是保证行政立法合法化、科学化的有效手段,是地方行政民主化的重要体现。现代行政立法要求公众广泛参与到立法过程中。近年来,全国各地广泛开展了公众参与行政立法的实践活动。座谈会、听证会、公开征求意见等形式的公众参与已经成为我国地方行政立法中的一道风景。但公众参与地方行政立法在制度上还很不完善,在实践中仍处于分散的、个案的阶段。目前研究地方行政立法中的公众参与具有非常重要的理论和现实意义。本文分为六个部分,第一部分是引言,指出了论文的研究背景和意义、国内外研究现状,明确了论文研究的理论工具和方法,并分析了论文写作的难点、创新点和不足。第二部分阐述了公众参与地方行政立法的理论基础与价值。在对公众参与、行政立法、公众参与行政立法等概念做出解释的基础上阐述了公众参与地方行政立法的理论基础和价值意义。理论基础包括人民主权论、参与式民主理论、正当法律程序原则、行政法学中的控权论。价值意义包括推进依法治国基本方略、提高政治民主化程度、保障公共利益和公众利益、防止行政自由裁量权的滥用、保证地方行政立法的科学性与科学性等方面。第三部分介绍了公众参与地方行政立法的制度现状,主要是对《立法法》、《规章制定程序条例》、《广州市规章制定公众参与办法》中的有关公众参与的法条规范进行了梳理和分析。第四部分对公众参与地方行政立法的实践状况进行了案例分析。剖析了北京市《酒仙桥危改工作补充意见》、《广州市亚洲运动会知识产权保护规定(草案)》的公众参与情况。第五部分对影响公众参与地方行政立法的因素进行了分析。简要介绍了有利因素,着重分析了不利因素。不利因素包括社会方面的不利因素、制度方面的不利因素、地方政府自身方面的不利因素、公众方面的不利因素和信息互动方面的不利因素。第六部分提出了推进公众参与地方行政立法的基本思路。通过对影响参与因素的分析提出了完善我国公众参与地方行政立法的对策路径。包括地方政府需要树立全新的行政立法观念、完善公众参与地方行政立法相关制度、提高公众参与意识和参与能力、拓宽公众参与的方式和渠道等方面。完善公众参与地方行政立法,并非朝夕之事,还需要很长的路要走。希望本文的研究对保障公众的立法参与权,促进地方行政立法民主化有益。
[Abstract]:Local administrative legislation is an important part of our legislative system. Public participation in local administrative legislation is an effective means to ensure the legalization and scientization of administrative legislation and an important embodiment of the democratization of local administration. Modern administrative legislation requires extensive public participation in the legislative process. In recent years, the practice of public participation in administrative legislation has been widely carried out all over the country. Public participation in the form of forums, hearings and public opinions has become a scenic spot in our local administrative legislation. But the system of public participation in local administrative legislation is not perfect, and in practice, it is still in the stage of dispersed and individual cases. At present, the study of public participation in local administrative legislation has very important theoretical and practical significance. This paper is divided into six parts, the first part is the introduction, pointing out the research background and significance of the paper, the current research situation at home and abroad, clear the theoretical tools and methods of the paper research, and analyzes the difficulties, innovations and shortcomings of the paper writing. The second part expounds the theoretical basis and value of public participation in local administrative legislation. On the basis of explaining the concepts of public participation, administrative legislation and public participation in administrative legislation, this paper expounds the theoretical basis and value significance of public participation in local administrative legislation. The theoretical basis includes the theory of people's sovereignty, the theory of participatory democracy, the principle of due process of law, and the theory of control in administrative jurisprudence. The significance of value includes promoting the basic strategy of governing the country according to law, improving the degree of political democratization, safeguarding the public interest and public interest, preventing the abuse of administrative discretion, and ensuring the scientific and scientific nature of local administrative legislation. The third part introduces the current situation of public participation in local administrative legislation, mainly combing and analyzing the relevant regulations of public participation in "legislation Law", "rules of procedure" and "measures of Public participation in rules and regulations of Guangzhou City". The fourth part analyzes the practice of public participation in local administrative legislation. This paper analyzes the public participation in the "complementary opinions on the crisis and Reform of Jiuxianqiao" in Beijing and the regulations on intellectual property Protection (draft) of the Guangzhou Asian Games. The fifth part analyzes the factors that affect the public participation in local administrative legislation. The favorable factors are briefly introduced, and the disadvantageous factors are emphatically analyzed. The disadvantages include social factors, institutional factors, local governments themselves, the public and information interaction. The sixth part puts forward the basic idea of promoting public participation in local administrative legislation. Based on the analysis of the factors affecting the participation, this paper puts forward the countermeasures to perfect the public participation in the local administrative legislation. Including local governments need to establish a new concept of administrative legislation, improve the public participation in local administrative legislation related systems, improve public participation awareness and ability, and broaden the way and channels of public participation. Improving public participation in the local administration and legislation is not an overnight thing, it still has a long way to go. I hope this study is beneficial to the protection of the public's right to participate in legislation and to promote the democratization of local administrative legislation.
