【摘要】：1898年至1912年间是梁启超法律思想成熟、完善的一个重要时期。这一时期梁启超研究了中国的传统法制，提出了完整的“合群—权利论”思想，，还在归国前夕提出了一系列完整的宪政主张。这些构成了梁启超在流亡日本时期法律思想的主要组成部分。 本文的研究目的在于整理和深入研究梁启超在流亡日本时期的法律思想。本文主体分为五个部分，前四个部分是：“合群与权利思想”、“对中国传统法制的研究”、“宪政思想”以及“对中国国家制度的探索”。本文的最后一部分讨论了梁启超流亡日本时期法律思想的特点以及梁启超法律思想的影响。
[Abstract]:From 1898 to 1912, Liang Qichao's legal thought matured and perfected. In this period, Liang Qichao studied the Chinese traditional legal system, put forward the complete thought of "group-right theory", and put forward a series of complete constitutional views on the eve of returning to China. These constitute the main component of Liang Qichao's legal thought during his exile in Japan. The purpose of this paper is to study Liang Qichao's legal thoughts during his exile in Japan. The main body of this paper is divided into five parts. The first four parts are: "the thought of group and right", "the study of Chinese traditional legal system", "the thought of constitutionalism" and "the exploration of Chinese national system". The last part of this paper discusses the characteristics of Liang Qichao's legal thought during his exile in Japan and the influence of Liang Qichao's legal thought.
