民国初年日美两国在华商标权之争——以1915年凡士林商标侵权诉讼案为例

【摘要】：1915年凡士林商标侵权案是日本企业侵权美国企业商标权的一个典型案例,该案折射出中国保护涉外商标所牵涉的错综复杂的法律关系。上海华商售卖日本企业生产的凡士林商品,该产品涉嫌侵权美国歉斯勃罗公司商标权。歉斯勃罗公司无法向日本法庭控告日本企业侵权,只得向上海租界会审公廨控告售卖该产品的华商。日本、美国政府迅即介入案件,北京政府外交部被迫牵涉其中。日本方面认为,日本企业凡士林商品曾在日本注册,中日条约有保护日本商标的规定,会审公廨无权受理此案;美国方面认为,美国企业凡士林商品在上海行销多年,享有商标权,中美条约有保护美国商标的规定,会审公廨必须惩治华商侵权行为。北京政府外交部将难题推给会审公廨。几经曲折,会审公廨最终做出美日双方能够勉强接受的折衷判决。
[Abstract]:The Vaseline trademark infringement case in 1915 is a typical case of Japanese enterprises infringing the trademark rights of American enterprises. This case reflects the complicated legal relationship involved in the protection of foreign trademarks in China. Chinese merchants in Shanghai sell Vaseline products made by Japanese companies that are suspected of infringing the trademark rights of American apologetic Sparrow. Sparrow is sorry that it was unable to sue Japanese companies for infringement in Japanese courts and had to sue the Chinese merchants selling the products to the mixed Court of the Shanghai concession. Japan, the United States government immediately involved in the case, the Foreign Ministry of the Beijing government was forced to be involved. The Japanese side believes that Japanese enterprises Vaseline goods were registered in Japan, and that the Sino-Japanese treaty provides for the protection of Japanese trademarks, and the mixed Court has no right to handle the case. The United States believes that the Vaseline products of US enterprises have been marketed in Shanghai for many years. With trademark rights and the protection of American trademarks in the Sino-American treaties, the mixed Court must punish Chinese businessmen for infringement. The Foreign Ministry of the Beijing government pushed the problem to the mixed Court. After several twists and turns, the mixed Court finally reached a compromise judgment that the United States and Japan could barely accept.
