法律硕士职业化培养问题研究

【摘要】：我国法律教育实行的是三个类型、三级学位的制度,即培养方式分通识教育、研究型教育和应用型教育三种,学位上有学士、硕士、博士三级。法律硕士全称法律硕士专业学位,是我国新兴的一种教育形式。从其定位和培养目标看,其教育性质属于硕士层次培养应用型法律人才的职业教育,因此,在培养方式上应采用职业化培养模式。虽然法律硕士教育开办十多年了,但办学模式还不成熟,在职业化培养中存在诸多问题,这些问题表明法律硕士教育没有达到职业化培养的要求。通过定位和实施两个角度进一步分析,发现这是由于法治现代化程度不高、法律教育体系混乱和法律硕士教育制度不健全等原因造成的。因此,应加强立法,理清关系,转变观念,来保障法律硕士教育与法律职业的衔接、规范法律教育体系、创新法律硕士教育的培养方案,从而坚定法律硕士教育在定位和实施上职业化培养的方向,使法律硕士教育成为法律教育的主渠道。全文主要分四部分展开论述：第一章,通过介绍法律硕士创设背景和历程,了解法律硕士教育的来龙去脉,并对其性质和特点作详细的分析,为深入探讨法律硕士教育问题奠定基础；第二章,根据法律硕士教育的实际情况,发现法律硕士教育在教学管理和就业上的问题,通过对问题总结得出一个结论：目前的法律硕士教育没有实现其培养目标,也没有形成预设的职业化培养模式,培养效果和质量令人担忧,现实中的状况与理想上的法律硕士教育还是存在一定的差距。第三章,以定位和实施两个角度,探讨律硕士教育在职业化培养中存在问题的原因,发现这些原因实质上是法治体系和法学教育体制的问题；第四章,根据前面的论述,提出一些改进法律硕士教育的思路,以坚定法律硕士教育的职业化培养方向,并在整体上有所进步。
[Abstract]:There are three types of legal education in our country, that is, general education, research-oriented education and application-oriented education. There are three levels of bachelor's degree, master's degree and doctor's degree. Master of Law is a new form of education in China. From its orientation and training goal, the nature of its education belongs to the vocational education of cultivating applied legal talents at the master's level. Therefore, the mode of professional training should be adopted in the way of training. Although the master of law education has been established for more than ten years, the mode of running a school is not mature, and there are many problems in the training of professionalization. These problems indicate that the education of master of law has not reached the requirement of professional training. Through the further analysis from the two angles of orientation and implementation, it is found that this is caused by the low degree of modernization of the rule of law, the confusion of the legal education system and the imperfection of the legal master's education system. Therefore, we should strengthen legislation, clarify the relationship, change ideas, ensure the link between law master's education and law profession, standardize the legal education system, and innovate the training scheme of law master's education. In order to strengthen the orientation and implementation of the orientation and implementation of the orientation of the legal master education, so that the master of law education become the main channel of legal education. The third chapter discusses the reasons of the problems in the professionalization of law master's education from the angle of orientation and implementation, and finds that these reasons are essentially the problems of the legal system and the legal education system; the fourth chapter, according to the previous discussion, This paper puts forward some ideas to improve the education of master of law in order to strengthen the direction of the professionalization of the education of master of law and to make some progress on the whole.
